Ok I have to admit it, it's bad for mercenaries. And it's also exploitable... So not really usefull...
But somehow a lot of people have been complaining about the wars declared on them without any reason. We have to admit there are 2 kind of mercs: those declaring wars because they were paid for that and carebear pirates who declare wars because they want to hunt in 1.0. The thing is that ccp must not be happy to have some erm... "unsatisfied" customers who don't appreciate to get their ass kicked without any reason.
Personnaly I think it's dangerous to limit the possibility to declare wars in empire space. First, no more wars for market control (although they are not a majority). Second no mercs wars in empire space which means no more mercs. Third it's exploitable so basicly my second statement in untrue. And finaly, it's just making the war process more complex without really changing it.
So even with this system people will be unhappy. Not only the victims of mercs, but also mercs. In one word: USELESS.

This is what I have been told but I will try to gather more information or relay any major questions or concerns. But keep in mind I'm just a moderator and I wont know all the answers either nor can I ask everything.

There have been in the past and are now a number of so called PvP players that have as their sole purpose to kill. Just kill, no rhyme or reason other than to get their name on the top of the most kills list and the lowest security rating. They specifically pick on new players that are unable to defend themselves and have no idea what is happening. They also target newly formed corporations and declare war on them so that they can kill them in supposedly safe empire space as they learn the game mechanics. This is not good for the game at all. We need more players not less, and until a new players gets a foundational understanding of the game there should be some protection in place, or they will leave. That is not good...
No matter what some of us may think, there are those here that are not here to play PvP. How would you suggest that issue is addressed? Which really needs to be considered.
Personally, this is the part that bothers me:

here we have a prime area for those "kill just to kill" players to form an alliance, and kill anybody they wish without fear of retaliation. This is a loop hole that really needs to be addressed.

It is nto a loop hole. Most of the pirates in this game (like me) have some terrible sec status. I never get to see high sec again. I need to do about 15 hours of chaining 750k BS in order to be able to get into 0.5 territory. Most of the n00bs hang out in high sec space anyway. So they are all safe from the likes of me, unfortunately.
What you can do is make sure that no character under 1 month of age can be fired upon, no matter what. Unless of course he starts shooting you first. Make your guns malfunction when you shoot them or something. Or make it that you will be criminaly flagged for an hour towards CONCORD. In low sec they are of course fair game. No sense in letting scout alts run around freely.
At least this will allow n00bs to get aquainted with the game, and give them some protection to the world around them.
