ok here this out..
I am currentlyworking nights as CCTV operator...
I am in middle of a set of night shifts, when this morning I am woken by ver ver loud drilling from next door, I have tried to get in contact with the builders... no luck, and it seems to be continuing for some time...
I contact my boss, and he simpley gives me 'we have all had it before you will have to just deal with it'
Surely if I am unfit for work, I am unfit for work?! he is claiming I cannot have it off sick, but will have to rearrange some of my holiday leave dates to accomodate for tonight, and take tonight off as leave?!
Is this right? or am I being screwed over by my boss?
No wonder people are often not honest and just call in sick with lies!!!

Essentially, you are unable to get to sleep because of the builders next door, correct?

Yes and no.
Your boss is essentially saying "**** happens" and it's true - we all have times where we cannot sleep and then have to go into work the next morning (or evening in your case) and I agree with your boss in that regard.
If you are claiming that the sleep disturbance is more than just "being tired" and that you are medically unfit for work then no, it's not reasonable for you to go into work in an unfit state.

If you are medically unfit for work then tell your boss that and don't come in.
If you are "just a bit tired" and didn't get a good sleep then you are probably on thin ice.

just a bit tired? nah its more than that
I got home at 6am, and went straight to sleep, I was asleep for 2 hours roughly and then the noise started, and now I am unable to sleep, due to headache and the continuing noise, hell I have even tried some ear plugs!!
So now I am awake, all day, and have to work 10pm til 6am tonight, I am very very tired, barely able to stay awake, yet he thinks its ok for me to not only work, but drive in this state!!!

I agree with the above poster but would ask what is your job. Does it require you to be alert at all times, such as for handling hazardous chemicals, prison guard and what not or is it (this is really just to the opposite end of the spectrum so please dont take offense) just janitor work? If its the former id say yeah the boss is pushing it, if its the ladder chuck an energy drink or coffee and suck it up. On an unrelated note, Kneel before Zod! |

Majority of Bosses in the average firm are usually ****s, thatÆs just the way it is. But yeah if my boss doesn't cut me any slack regarding stuff every once in awhile. Then I'll start being a ****, not doing over time when needed etc.
But as for your rights, you can't do a lot in that situation IÆm afraid.

you should have gone to a friends or relatives to get some sleep. its not works fault your neighbours are having construction done but i do feel for you.
He clearly said he was a cctv operator lol

It's your problem and you have to deal with it in my opinion. It sucks but people are right when they say **** happens. The builders have to work within reasonable times i.e. not too early and not too late or else they will probably be keeping someone awake with the noise, you do night-shift which is just bad luck.
Are you not able to get a few hours sleep before you start your shift on the evening? I used to have real crap shifts when I did security (16:00 to 07:30 the next morning) and when my neighbours were doing work on their house I was totally screwed, nobody's fault and down to just crap luck. Worst comes to the worst and you can't go on working, call the doctors for a sick note for time off work. ------

Your post is a little confusing as it sounds like you are either sleeping at work or somehow your boss at work has control over your sleeping arrangements.
My guess is you mean you asked your boss for advice regarding noisy construction going on next door when you are trying to sleep during the day, not that your boss has any actual control over the situation.
Anyways, you are screwed. During the day people are allowed to make however much noise is reasonably necessary to do whatever it is they need to do. Construction must be done. It must be done at some time. Do you want them to do it in the middle of the night when you are at work, waking up everyone else? Not going to happen, sorry. ----------------------------------------------------

Think you got the wrong end of the stick, I read it as he wanted time off because he isn't getting sleep between shifts but his boss wouldn't give him the time off unless he puts in a holiday. ------

Sleep dreprived is not sick...
If you are going to bed just after you finish work try shifting your sleep period forward and get up just before you have to leave.
otherwise put in a holiday, get used to the noise or take non paied time off if you can.
You can get used to sleeping in noisy enviroments, try sleeping under a approch patteran of 2 Sqns of fighters across from a bomb shelter with a really fecking noisy enviro plant...
You could also try hitting your doctor up for sleeping pills as well ========= "I am not saying there should be capital punishment for stupidity, but why can`t we just take the safety labels off everything and let the problem fix its self |

I gotta say...that's a pretty weak excuse.
Maybe I'm saying it as a father of a newborn....but 2 hours of sleep a night for me is common. Yer boss is probably going with the old axiom "I understand that you are having problems, but at no time now, or in the future, will your problems become my problems". I happen to agree with that. Being someone that has worked with more then their fair share of people lacking accountability or unable to adapt to a given situation, maybe it's just time to "man up". Don't mean to sound like a hard ass (yes I do), but that's my opinion.

I happen to live in a large apartment building, and let me tell you, people drill/hammer/****/**** all the time and it drives me freaking crazy. Unfortunately, short of a winning lottery ticket, I have no other choice but to freaking endure. Sometimes, mostly on weekends, I yell at them, I mean come on, screw everyone drilling in a Sunday afternoon. Ofc this doesn't help, but at least I make my very personal point
It's freaking annoying, but unless you have the budgetary means to move the heck out of there, you should pray for late evening to come when people usually(!) don't do this. Yeah, it sucks ass, but there's nothing one can do.

Step two: Get a brown paper bag, maybe two (put the first one inside the second one).
Step three: Take a giant dump into the paper bag. Remember to leave the ****ty toilet paper in there, too.
Step four: Take poo filled paper bag to boss' doorstep.
Step five: Light bag on fire.
Step six: Ring doorbell.
Step seven: Run like you've never run before.

I assume you sleep near the window and thus source of noise?
If so for a short period of time move your bed as far away from the racket as possible and use earplugs... And if that still doesn't work try sleeping pills or something to help you sleep.
Also, unless you work with hazardous materials or something that can get people killed if you screw up then you have good reason to call in, otherwise you have no grounds.

Or...if it's a right to work state....his boss can say that his personal situation is interfering with his ability to perform the job and simply let him go. Oh yeah...there's that.

At my place of employment we have PTO (paid time off aka vacation time). You have to use 5 consecutive days of PTO hours before you can crack into your sick leave. So if you call in sick, guess what? You use a day that is typically used for vacation.
Grow a pair!
You should see what some of the people I work with deal with and make it to work every day. My issues pale in comparison to many of them and my story is not for the faint hearted.
I have been dealing with this for almost two years. It started on the side of my leg and then migrated to the back of my thigh. Guess what? Most of those two years I have had a hard time sleeping since every time I rolled over it would wake me up; and I am a very light sleeper Other then the 3.5 months I had to take off to recover from surgey, I have not taken a single day off due to pain or lack of sleep.
But to be honest, this wound is the primary reason that I have not played much EVE in the past year. It was just too pianfull to sit on for too long. Doing pvp OPs and having to get up and leave the comp often is not suitable.

Thats the security business for you. I ended up pulling a 19 hour shift (thats not including the hours I had already been awake) due to a temp guard pulling a sicky and they ended up calling me in again 10 hours later for another 7 hours. Only reason I did it is because I like the people on site. Also I just got payed by cheque and last time this happened it bounced and I had to fight to get my pay.
Basicaly if your thinking of getting into the security business give yourself a slap and look for a better job. Its nothing but hassle.

Yeah you should have just phoned in sick without using the noise explanation, never expect a boss to show you sympathy.
I used to work nights in a hotel doing 11pm to 7am. Did it for 6 months and had a terrible time getting a decent period of uninterrupted sleep.
1 suggestion I can make is to sleep at work. Most nights I would go in at 11pm, work until about 1:30/2am then sleep on the sofa in reception for about 3 hours before getting up at 5am.
Another suggestion if this is going to be an ongoing problem is to buy yourself a decent pair of ear defenders, use them in conjunction with ear plugs and you shouldn't have any more problems with power drills.
