We all get annoyed when threads are derailed. We don't like when conversations turn into mudslinging contests and shouting matches between two people or even whole groups of people. In most cases, it all starts from minor misunderstanding. All of us who participate in these discussions, we are overconfident in our abilities to solve these little conflicts. Both sides believe they do something right and their opponents are wrong. And we reply to them, in hope that this time we prove them wrong, and that this will end this little conflict. But they think the same, and the thread goes places.
Let us be honest with ourselves, our ability to stop our own conflicts is lacking and we all are blinded with our overconfidence. On the other hand, a neutral view on two sides can reveal that both are right in some terms and wrong in another. A neutral mediator can help you find common ground and solve misunderstandings before they turn into a large drama that will clog the thread and stop the conversation, causing frustration not only to you and your opponent but to everyone who will be reading your replies.
This is was my idea behind the tribunal when I tried to start it for the first time, a union of people who help other people solve their problems between themselves. I see the situation with conflicts haven't changed, and I want to try it one more time.
The original thread (closed due to lack of activity) is here: https://forums.eveonline.com/default.aspx?g=posts&t=503323
I would like to make some adjustments, however. First of all, this time it will be completely FREE. It turned out that for some capsuleers 200k isk were looking like astronomical summ of money to even consider it a scam. Well, it isn't. All judges now, including myself, will be working purely as volunteers helping those who will need it.
The second point, which is probably my fault in explaining, is that people were requiring from the tribunal some sort of punishment. It is not what we are going to do. If you have someone offended you criminally, there are DED, CONCORD, CRC, or local authorities like Provi Bloc who would add your offender to KOS list. What I am offering is solving issues between two parties in a peaceful way. In most of conflicts, both of sides do something wrong, and both of sides must do some sort of effort for the common solution, and we all must work together to find it. The tribunal will help to find what concession each of sides must do in a fair and impartial way. I am not really interested in working with that sort of people with the mentality of finding someone being "guilty" just to "punish" them.
If you think that you've got yourself in the conflict, if you think that someone blames you in something you didn't do, if someone offends you in the Galnet or Neocom channels, I beg you, don't answer them there, don't try to solve it yourself. Please find a neutral arbitration and solve all your little conflicts before they grow into huge dramas!
I hope that this Tribunal can become eventually such neutral third party, providing service to everyone who needs it. |

Interesting idea.
I'm ... a little skeptical it'll actually work, though. I think most people only look for an intermediary when the argument's a little more than just a disagreement in a thread.
Maybe you could make some progress on the "Kim-haani - versus - Virtually, the World" problem, though I'm not sure anybody involved will actually be happy to hear from you and it sounds like you're not planning on inserting yourself into stuff you haven't been invited into. |

An incident on one of the Summit channels recently gave rise to a desire to make use of this tribunal, but the conflict was resolved before I actually went looking into wether it was still active.
Although I am also skeptical about whether it will be used, I'm willing to give this a shot.

More than any factional differences, the main cause of problems on the IGS and really any neocom interaction is the nature of our communication.
We were meant to communicate through body language, in person. Over text, over voice, it is almost always going to lead to mistaken intent.

I don't see the problem of offering a private option like this. If people don't sign up for it, that's the company's fault for not offering a desirable service. Market economy and all that.

But like most on this thread I am skeptical that it will actually work.

Some of us discussed your effort earlier. Most people agreed it was a good idea, but some question your credentials as 'impartial'. Can you speak to that concern? |

Oland Jan wrote:Some of us discussed your effort earlier. Most people agreed it was a good idea, but some question your credentials as 'impartial'. Can you speak to that concern? We don't have currently a case to make a decision whether I am impartial to it or not, thus such sort of concern is way too far-fetched and unwise.
However, the question of impartiality in general is a serious one and I am offering following instructions to ensure impartial decision: 1) I won't be the only judge, who will be solving the cases. Currently we have already two. 2) A judge shall not be a participant* of the conflict under discussion. 3) A judge must not be related to any of participants through family** or corporation*** bonds. 4) The decision should be taken by a collegium of three judges with at least two of them agreeing with it.
*)Participation in the conflict includes vocal support of one of the participants prior to tribunal sessions in regard to the investigated conflict (support to participants in any other unrelated business is allowed).
**) Family relations include romantic interest, active dating relations or them living together.
***) Corporation bonds include only being members of the same capsuleer-owned corporation(not baseliner ones like School of Applied Knowledge, Perkone, and so on) either during the process or within 3 year period before the process. Exclusion can be made for corporations like EVE University. |

This is based on the idea that most shouting matches on the summits happen because of miscommunications, and if people just would sit down and talk about it, everyone would be friends and there'd be cookies.
Which is not how it works.
That said, should your tribunal ever receive a case request that requires understanding of Matari ways, I respectfully offer my services. Despite having been is several shouting matches myself, I am a trained and experienced diplomat withe plenty succesful negotiations for blue behind me.

While I don't disagree, Miss Rhiannon, most of the conflicts I've personally had with other capsuleers have been because of miscommunications. But I can see I'm likely somewhat rare in that regard.

There are times when talking to, instead of at, someone would be beneficial.
The late Villore Assemblies being an example of such. While short-lived, it was not without its accomplishments. An established framework with clear guidelines and expectations could be beneficial.

The OP made a significant mistake in using the word 'judge' to describe what are in fact, mediators. This private tribunal has no force in any jurisdiction's law. The panel, as described, is aiming to help resolve conflicts, not to make legal rulings which obviously can not be enforced.
In mediation, as in diplomacy, words matter.
The weak can never forgive. Forgiveness is the attribute of the strong.

At this juncture I'd like to dispel the rumor that I take my grooming seriously.
As such I don't have hair care secrets. I use only water for washing, and a vibro or shaver blade for shaving my head about weekly or bi-weekly. And once a month I have a little of the long hairs cut.
