The theif is only flagged to the owner and the owner's player corp. The theif will not be flagged to the owner's gang mates.

The only 2 ways of completely preventing the ore from being stolen are to dump it in an anchored secure container instead, or to have a hauler buddy pick the ore up as soon as you put it in the jetcan.
Alternatively, have the jetcan originate not from the miner but the armed escort so that he gets the aggression timer benefit. Many ore tieves leave a mining operation with armed escort alone, especially when they have seen one of their kin been blown up due to assuming the defenceless ship had the attack rights.

This is not completely fool proof. What your'e doing is not taking into account three variables.
1. Is your buddy in the industrial faster than the theif in dragging and dropping the ore from the container to the hold.
2. That your buddy doesnt experience a lag spike at that moment.
3. Your buddy is actually sitting at the computer to make the transfer.
As the poster said, a anchored secured container is the one true way to assure a ore theif can not get to that ore, assuming your mining opt isnt too large, a giant secure container only has 3900 units of space, a group of 3-4 miners can easyly fill that and have excess in a single round, big trouble for the mining opt when the industrial has to make a run to the station (miners are either forced to drop the excess into jetcans or hold it in their holds and run the risk of the mining beams over filling their cargoholds, halting the operation until the iteron is back.
If however everyone (or just one or two) in your party is packing T2 drones, the theif will think twice before attempting anything (3 mining barges, 5 drones each, all t2 drones = 15 very fast, very aggressive t2 drones.
Your best defense against ore theifs is to show them that its not worth attempting what they are keen on doing.

It depends. I know some pirates that if they saw 3 mining barges with T2 drones popped in high sec, they'd steal the ore, pop the drones while scrambling the barges, then pop the barges.
Alternatively they'd use a weak ship, let that get destroyed, then come back in something bigger.
Of course there's nothing stopping the miners doing the same, but the pirate is likely to have more PVP experience than them.

While those 3 points are valid, it has been my experience that most theives will leave you alone if you are working in a team this way. And even if the theif does come over and start looking in the can, all you have to do is just stop moving ore till he leaves. Most people who steal ore are looking to actually steal something, not just sit there staring at a jetcan with 1 unit of EMP S in it ;) -=^=-

It depends on the pirate I guess. Ive seen an ore theif do a 180 rather quickly when t2 drones were deployed in a mining opt.
And again it depends on the pirate. Is he the type that doesnt mind sitting their waiting for someone to make a move? I mean so long as hes sitting within the range of the jetcan all mining will stop to keep him from stealing the ore.
