long and short of it, i got arrested tonight for sitting on a bridge watching the view while getting my mind together about going to iraq again on monday.
no miranda rights, no explination as to why i was being arrested, but it didnt bother me. there is no way she could have hurt me. ive taken tasers, been knifed, and been shot (all before the military even).
funny thing is my POW training drove the arresting officer absolutely crazy while trying to book me, my sudden inability to stand for the picture, my need for water, my chest hurting, bla bla bla...
she actually let me go and said "youre quite a trip"
guess thats cop speak for "thanks for not killing me in a split second and being such a cooperative perp, heres your disorderly conduct summons to court, a charge based on the fact you were sitting on a bridge looking at a river by yourself at 4 in the morning when i decided to come punk you"

Perhaps it was a "Right we have done what we need to here is your court summons now get out."

OK to prevent the whole USA politics crap lets get one thing straight.
lets NOT talk about USA policing laws, i want everyone to share their stupid encounters with law enforcement.
Besides, jim, youd fit just fine in the US, your narrow mindedness assuming i live there proves it.

Oh sorry, the term "miranda rights", "POW" and the post being about an abusive police force made me think of the USA. Nobody else would ever do that, ever, im sure. Im SO narrow minded.

What do you mean? I was talking about your story above. Did I misunderstand the fact that you were taken and questioned by the cops for sitting at a bridge?

Only law enforcement story I'll recount on here: long, long ago, I was pulled over for being 16 and driving a Camaro. Tried to claim I was speeding; I had my cruise control set 5 mph below the speed limit and was repeatedly passed, and had two witnesses in the car who were looking at the speedometer when the cop blue-lighted me. He got flustered and stalked off when the woman riding with me (in her 40s and owner of said car) demanded to see the readout on the RADAR gun.

I had a cop come to my door asking for someone who didn't live there. He asked if I knew him, I didn't. He then asked if I'd seen any black men around. It seems that the closest he had to a description was the man's race, but come on.
"Yes, officer, there are black people living around here." was the best I could muster. ----- I'll be in my pod |

I got followed out of Wal-Mart by a cop once. Me and a few friends were restocking on the dew at like 2am so we could finish watching anime. The cop assumed a bunch of 18 year olds were obviously up to no good.
He walked up to my car, asked for our IDs. When he checked them, he found nothing. Then he asked if I had any drugs or alcohol in the car.
I was so ****ed that he was harassing us just because we were teens that I told him "No sir, we finished them off before going into the store."
My friends were shocked as heck, and the cop shot me the dirtiest look ever before throwing the IDs through the car window.
I laughed about it the whole drive home :) ------------------

One time I got off work and was driving home and I saw the officer whip around behind me and I knew I was ****** cause I didn't have insurance on the truck.
He pulls me over and ask for the ID, insurance and registration so of course I tell him I have no insurance and he takes the other 2.
Well a couple minutes later he comes back to inform me that my tags were expired and my license was suspended to go along with no insurance. He said that he could arrest me on the spot which I knew but he was willing to make a deal. He would give me a ticket for no insurance if I got out of the truck and walk home. Seemed like a nice day for walking so I chose that path.
Next day I walked to the insurance place and got my insurance. I walked to the DMV and got my SR22 and new tags, and walked to the courthouse and paid my fine, then walked to a friends work to give me a ride home since I walked roughly about 10 miles that day. _____________________________________
On a new years eve I went to a show with a bunch of friends. While we were waiting for the show to start we decided to head over to the grocery store and pick up some cheap cigars. We were waiting at the corner waiting for the light to change when we noticed a couple cops in a squad car staring at us and we figured we were gonna get pulled over cause the three friends all looked younger than 18 and they were smoking. Sure enough as soon as the lights changed the disco lights went up. They got out and talked to us and asked for our ID's and asked us to sit on the curb in front of the car. While we were waiting we decided to have a little fun so we got on our knees and put our hands behind our back. The officer got a kick out of that and let us go.

This is going back awhile but here's mine (actually have a few).
I was 17 and a friend of mine and I headed back to my parents' house after a school dance to raid my parents' liquor cabinet. On the way he wanted to stop by his place for something which was only a mile from my house so we stopped there first (luckily). They had a gravel driveway which he had just raked that day and his dad was a freak so he asked me to park on the street (absolutely legal there).
We came out of his house to see a squad car spotlighting my car and a cop walking around with a flashlight. I assumed someone had messed with my car so jogged down to the cop with my friend close behind. Cop started with the usual questions of "Do you live here" and "Is this your car" which we answered but he got confused and thought it was my friend's car...no big deal but seemed to irk him.
He asked to see ID which we showed him and he called in (no problems). He went to the neighbors across the street and woke them up (around 10:30p and they were elderly) and questioned them about a missing decorative lamp post (which they told him had been knocked down weeks earlier...no lamp post on ground, leaves from trees in the hole). He asked if I had been drinking or doing drugs (I hadn't...yet). He asked if any were in the car to which I replied no. He had me open the car to search it. He had me open the trunk to search that (all illegal searches by the way but I was being cooperative since I had a party and my girl friend waiting). He looked under the car.
Totally clean on all counts. I asked why all the fuss to which he repsonded, "Why were you running?" I said, "You mean running from my friend's house right there towards you?" He nodded and I said, "Well I thought you were here because someone hit my car or something. I certainly wouldn't have run right up to you had I done something wrong." He then started with a round of, "Did you knock down the neighbors lamp post" sort of questions.
He had us wait in my car awhile while he fiddled with whatever in his sqaud car. Mind you this has been going on well over 30 minutes now. Finally he comes back to us, gives us our IDs and tells me to get out of his sight in the next 2 minutes or he'd arrest us for curfew violation (he had detained us at this point till about 2 minutes before the town's curfew law hit).

In all honesty, most of his story sounded a little too fishy to me but it gave us a topic atleast.
As for an officer searching a vehicle all they need is probable cause. To search a building they need a warrant. I've had my vehicle searched on numerous occasions. I love it when they try to point out that my $5 rusted, dented, POS macheti (sp) is 'concealed' and I'm like "yeah, right along with all my other tools I use for this truck"
And I got pulled over once for no mudflaps on the company truck. I found out I could be cited for it so when I got back to the store I let my manager know I wasn't getting behind the wheel until that flap is back on.

Since you did get a court date and stuff, make sure you bring up the fact that they did not issue your Miranda Rights. No Miranda Rights = nothing they can do. You HAVE to be read your Miranda Rights else they cannot legally hold you.

True but in my case there was NO probable cause. None. Not even a hint.
Of course that doesn't change the fact that police can largely make it up as they go along. Luckily my friend was with me to act as a witness if it came to that which might have saved me from worse treatment.
A friend of mine is an officer with the Chicago Police Department. He has told me point blank if a cop wants to arrest you they will find a way. Almost always there is something they can get you for and barring that they can make stuff up in a pinch and almost certainly get away with it (infamous "broken" tail light because the cop smashed it comes to mind).
Some police are worse than others. The Chicago police (where I live) are rather corrupt but it is a workable corruption of sorts. They shake down the bad guys and steal their drug money or get payoffs from crime types to conveniently look the other way. But for average Joe Citizen they tend to leave them be. As long as you have not done something heinous Chicago police will often let you go for most minor crud. As long as you are polite and cooperative about it. Give them a hard time and lord help you. They will positively ruin your day and a few after as well (including ass kickings for "resisting" arrest).

Yeah my father was a MP for the Air Force and afterwards became a Highway Patrolman then a officer for the city we live in now. He's been retired from that for like 20 years now. And one of my friends dad was an officer who was killed when a drunk driver hit his car (his personal car, he was taking the family on a trip).
I know alot of the ongoings an such from what my dad taught me which is why I removed most of my bumper stickers from my truck. I also frequently check all my lights since they like the whole pulling you over when a light is out (it's called fishing, they're hoping to find more). When I get pulled over I remove my keys from the ignition and toss them up on the dashboard then keep both hands on the wheel and I reach for NOTHING until they say I can. And of course keep to the yes sir and no sir questions.

Wait a moment there is something I don't get in that story... Why would POW training cause you to want water, make you unable to stand still and make your chest hurt? Surley POW training is supposed to help you survive not make things more uncomfortable?
Now for my stories the first is kinda funny te second is amazing:
This was back when I lived in Oman (a little known country close to dubai). We were having a BBQ but someone forgot all the knives and forks so I was sent to go bak and get them. However the rout back was through a bunch of small windy roads which I ended up lost in finally after a good 20mins and feeling very hungry my friend noticed that we had just gone past the right road so in my fustration I span the car around in a 180 and went down the road when I hear the screeching of a car behind me and the police scirens. Aparently the car that was parcked just ahead of us was a police car when I did the spin =/ But the funny part was that the cops couldn't speak english so I had to call a friend to translate and sit there while the phone was swapped between us. Finally after a long time of getting nowhere the cop decided it wasn't worth the effort and gave up trying to talk to me then in very basic English he says: "Maybe this spinny spinny ok in england (I had my british driving license) but here, in Oman, is not allowed. Don't do again".
Heres another story. Myself and two friends were walking down the street when we passed a bunch of people under age drinking. Just as we come up to them two cops walk round the corner. The guys who were drinking leg it and the cops accuse us of being drinking with them. We were 18 and the age is 21. To them there was a lot of evidence pointihg to us being guilty, three teenagers standy by a bunch of scattered beer bottles. But this is the crazy part... one of my friends was a muslim, when the cops accused us he squared up to them and started shouting right in their faces! He screamed "are you followers of muhamed?" when they said yes he replied that he was also a muslim and then he swore by allah that we had not been drinking, when they didn't believe him he replied shouting that they were not true muslims he then said "how dare they question what he had said". After he said that they stopped immediately, apologized and walked away! It was amazing. Imagine saying "how dare you question what I have said" to a european or american cop!
P.S. sorry if there is crappy spelling, I'm dyslexic and don't have time to check it all...
