Citizens of the EVE Cluster and the Caldari State.
Most of you are aware that the APEX Conglomerate has been the target of a recent investigation by the CBT. During his investigation, Mr. Davrin Yurisko harassed Conglomerate employees, turned files and records upside-down and generally made a big show of the fact that he'd made up his mind before he even arrived.
As of 04:36 EVT, we have learned from the CBT that Mr. Yurisko has gone missing and all his data lost in an apparent power surge, possibly due to sabotage by Mr. Yurisko himself.
CBT now wishes to send another investigator, but APEX will not be cooperating.
Over the past week, since CYI's original wardec, tensions continued to mount until it appeared that all the capsuleer factions in both the Caldari State and the Gallente Federation were heading for all-out war. This situation was defused by a sudden surge in propaganda which painted the Conglomerate as a disloyal organization engaged in illegal activities.
It has become clear to us that the CBT has already accepted this propaganda as fact and that the Conglomerate has no chance of a fair outcome to this investigation.
APEX will not allow its employees to treated so callously by the CBT and, as of this announcement, are removing ourselves from its jurisdiction. The Conglomerate now considers itself an independent capsuleer organization, no longer subject to Caldari State business regulations. Our driving force is now the well-being of our employees, our assets and our profit margins.
If any shareholders or business partners have concerns about the impact this new direction will have on our operations, we are confident that the disruption will be minimal. We plan to honor all contracts and hope to continue to do business with our current clients.

Sorry to hear all that, and I think I know exactly how you feel. It's too bad, but being kicked while you're down shows you how much the megacorps really feel about us independents.
I hear you made the move to Federation space. Congrats. It's a whole different world here.
Now I hope this war ends soon. There's really no need for it, other than for both of us to get in the way of each others' business. I look forward to working with you in the future.

There it comes. The law net of the Caldari State is already thin and yet Apex wishes to get away of it... Well, maybe piracy business is the most profitable one after all. Sure it involves murders, theft and killings. Sure it's a cancer in this galaxy but whatever...

Where did APEX express their will to pirate exactly? Nowhere in this release I beleive.
They simply stated they were no longer abiding by the business practices of the state.
Again the Federal whipping boys start to jump to conclusions.

If you withdraw yourself from a jurisdiction, it's a flee from justice and you become an outlaw. When a whole corporation entity is becoming out of the law, they become pirates. Although I think you may attach some lore and laws of you own to that word, pirate, they are, all the outlaws, all thoses who flee justice, all thoses who think they can steal and enslave at will, pirates to me.

I believe the Federal whipping-boy, if I can use your terminology Mr.V, is mistaking CONCORD regulations with State business practices, two of which are completely different things. -------

Incorrect.
Withdrawl from State loyalism does not brand APEX outlaws. They are still governed effectively by SCC taxing regulations and CONCORD/DED law, as well as the Yulai Convention. In no way are APEX outlaw, or in any respect even remotely close to being considered a "pirate" entity.
On the other hand, I will happily attest that no law, treaty or regulation governs my corporation or it's business practices.
That is the difference between APEX and an outlaw/pirate organsation.
Obviously the standard of Education within Federal borders has diminished since I graduated. Somewhat unfortunate for yourself and those in your position.

In short, I'm very happy about the removal of the CBT's jurisdiction. During my conversation with Mr. Yurisko he claimed several things without proof or the willingness to show proof and seemed to be looking for a sellout to bite his bait. If this is CBT's manner of treating an honest employee I must say I saddens me that they fall so low.

I honestly don't know what to expect anymore. His interview with me confirmed my suspicions that the CBT had already made up its mind about the allegations and was only paying lip service to the law and was going to prosecute us anyways, evidence or not. Everything I was presented was circumstantial at best with the rest of it being out-right hearsay and rumor. All questions were full of implied guilt and his mysterious and suspect disappearance confirm that there would be no impartiality in this investigation. When Mr. Yurisko had his nice sit-down chat with me (note that coffee and Biscuits were not offered), the entire interview consisted of him attempting to put words into my mouth with regards to APEX's leadership and actions.
PiF, I assure you that when the man left my hanger, he was alive.

While it is always sad to see a corporation leaving the State instead of lobbying inside of it, what differentiates the State from other governments is the inherent right of secession of individual corporations.
As long as APEX does not engage in criminal activities, I will personally keep them blue and I believe the Ekchuah Directororate will follow me at least in not classifying them enemies of the state.
While the Guristas have indeed gone over the simple secession and gone Criminal, negotiation with criminals cannot be a crime in itself; otherwise, all diplomacy is doomed to failure.
Diplomacy is the act of negotiating with criminals, whether they are federal lapdogs or piratical organizations is a detail.
Fly safe APEX, may business be good for you.
