Sony changes Playstation Network ToS: Class action waiver added.
So, if Sony screws up again, information is compromised again, and our credit card numbers are stolen again, we will have no legal recourse?

Hm. Well, so much for me getting a PlayStation 3 for Dust.

No business on Earth can put that into their ToS and get away with it.
Never would it be legally binding. In fact the idea that you can't take part in a class action is, dare i say it, wildly inappropriate? |

Sony has made it extra safe though. My kid has been bugging me to sign him up on PSN for months but you can't. I visit their sign up page about once a week and its always down for maintenance. If you can't sign up you can't have your credit card information stolen can you? |

The biggest issue I have with a console release is longevity. The playstation 3 is bound to be replaced by a new platform soon. There goes CCPs big plan for dust.
One positive note for a console release will be exploits, hacks, aim bots, all the wonderful things pc fps players adore, or despise.
That and one platform, makes stability much more manageable.
Still, I would love to see a pc port, even if it required the use of a gamepad. |

You know the old saying 'a little knowledge is a dangerous thing', this applies you to OP. Sony has not 'taken away your legal recourse' they have simply mitigated the chance of them facings a class action. You personally still have legal recourse options in the way of arbitration and court where appropriate. This simply means you + 10000 other subscribers cannot hire a massive lawfirm to sue and cost hundreds of millions in legal fees (yes class action legal fees are million + minimum).
If you live in the US there is something called the Federal Arbitration Code. This specifies what companies can and cannot do to force you into arbitration. Combine this with recent Supreme Court cases that state the arbitration code supersedes any state law + the issue of arbitration legality must be firstly arbitrated leads to a reduction in legal suits. In the end the consumer loses in a bad way. Arbitration is EXPENSIVE! and the fees must be paid upfront. We are talking thousands of dollars to even start the process and you have to do it on Sony's backyard. Sony has become has anti-consumer as a company can get regarding dispute resolution.
If you read the TOS there is a statement in there that states you can opt out of the arbitration only clause if you write to sony directly. I for one will never use sony's services in any way if I can avoid them. |

Don't worry my fellow Eve players. Dust is doomed to failure. Exclusivity serves one of two purposes.
1) It serves as a means to bolster revenue, focus marketing by putting together big names like Sony and some well known game publisher with a much anticipated release. It is usually the hosting network that pays to have such exclusivity over such a release.
2) It's a means for a big company such as Sony to protect its own interests. Big companies such as Sony like to invite in and entice little gullible companies with exclusivity and then completely squash them through poor promotion, poor support, poor service, poor performance and legal bindings from which such little companies cannot wrest their intellectual property to save their own lives ensuring Sony's own intellectual property is not negatively impacted.
Now, I wish CCP all the luck in the world. Unfortunately, I believe they've failed to recognize the second rule of Eve, "It's a tarp!". We want breast augmentations and sluttier clothing in the NeX! |

I wonder if with Dust, Eve players can simply keep blowing up settlements etc for laughs...what would be done about that?
I also have never understood why CCP are branching into consoles, I mean....Lets keep with PC games as the PC platform has so much more to offer than consoles, PCs give the developers something to play with at least.
I mean come on....the gfx on consoles suck so much hardcore a$$ its pretty funny compared to a decent PC/Lappy. |

Considering CCP's penchant for shitting on their own users, as well as the fact they are lying, cheating, scamming SOBs themselves, I think this match is made in Heaven.
The only problem is, many countries have laws on the books that say you can not have a third-party entity force you into a contractual obligation to give up certain rights. Denmark I believe is one, as is the United States. The enforcability of these items will come down to if Sony is doing this in bad faith.
Of course, if Sony says you can't sue them, then expect any sneaky lawyer to rev up class-actions against the game developers such as CCP. |
