i'm wondering if
1. if i jetcan mine and someone steals from it, can i kill them without concord or any of there friends or themselfs killing me after
2. if i can kill them can i also do this if it was a fleet member's jetcan? |

For number one you can kill the person who stole from you, but if you attack then them and their corp can shoot back. |

not true.
you can attack the person who stole from you, as can your entire (non-NPC) corp. if you attack them, then THEY (not their corp) can shoot back only at you (and any other corp-mates who have shot at them). |

If someone steals from your jetcan, they are flagged to you (and your entire corp if you are in a player corp). You are free to shoot at them -- though killing them is a different matter altogether. Once you shoot at them, they can shoot back, and 99% of the time, this is what they want -- to kill you first. Shooting them does not flag you to their entire corp. |

No. You only get kill rights if someone kills you when you aren't flagged to them for aggression. can flipping sets aggression flag, so no kill rights. |

What fleet you're in doesn't have an effect.
What corp you're in matters, because if you're in an NPC corp YOU own your jetcan, whereas if you're in a player corp, your corp owns the jetcan.
So the mechanic is this: a thief stealing from a jetcan gets flagged towards the owner. The owner can choose to shoot the thief. Once shot at, the thief can then "defend himself" and kill the owner(s).
Note that some ore thieves bait you by placing your ore in their can, and waiting for you to take it back, which then counts as you stealing from them.
