I've accepted a contract (courier) that contained a crate that was too large for my ship. Therefore I opened it and transported the stuff to the location where I should transport it as said in the contract w/o that crate and with multiple flights.
Now, when I want to finish the contract I'm asked for that crate. I can not find that crate anywhere, it's not in the starting location any longer. Where do I get it back? Can I re-create it in case it got lost? I mean everyhing is in order to finish the courier mission.
And: what's the deal with failing a contract? Is that hard? The contract was created by a friend who offers me some money for doing the contract and it has no collateral. So I won't loose anything from that deal, but what is the impact of these unspecified but important sounding "public records" it's spoken about with failing a contract?

Well, you just managed to break the contract if you opened up the package.
Failing a contract will be visible for others when they look at your contract history which may look bad on your reputation if you fail a lot of contracts. As you may know, reputation is everything in EVE.

So is there anything the original contract-contractor can do that this does not look like failed?

Didn't you see The Transporter 1-3? That guy gets in all kinds of trouble by opening his packages.
Maybe you could just contract the stuff to your friend via item exchange?

No, it will look like a failed contract, not much you can do about that. You can complete other contracts successfully so that your ratio of good:failed is nice, such as 300:1, and people won't think you're a scammer.
As far as your friend, you could offer to trade the items to him/her and get your collateral back, if that matters.
Basically, don't open the crate, that breaks the courier contract instantly, and you can't complete it even if you transport the goods. Always look at the size of the crate before accepting a contract, so there are no surprises.
Contract scammers can trick you by making a large size contract that doesn't fit in any ship, or by setting it to be delivered at a station where you can't dock, or by sending you through lowsec space so they can wait for you at a gate and kill you and steal the items (this will also force you to fail the contract and thus lose the collateral).

try contracting all the stuff to the initial creator of the contract at the price of whatever the collaterol was, maybe he'll accept if he didn't make it as a scam.

1. You can open a courier box and peek inside. Just don't break the box.
2. It is impossible to issue a public courier contract with no collateral. What you accepted must have been a private one. The records of this contract is only viewable to you and the issuer.
