If they have a security standing of -5.0 or greater... they are considered an "outlaw" and fair game to everyone. And yes, if you are lucky enough to point an "outlaw" pod, you can shoot to kill.
With kill rights, yes on that too. Be warned... some pirates are very wealthy and vindictive.

I simply suggest that you get your biggest ship shoot at them, and you will find out for yourself :)

Just to clarify, he means -5 or lower, i.e., between -5 and -10. If someone has a security status -5 or lower, they are an outlaw and you can shoot their ship or pod them without getting a global criminal countdown or having your own security status lowered.
Killing an outlaw will not give him kill rights on you, but this will not stop him from killing you in the future if he wants to.

Although it has already been pointed out, I think I ought to reinforce the point:
Shooting a pilot with -5 or below security status is perfectly fine and there will be no Concord response or kill rights awarded to the enemy pilot.
However, being a pirate myself (check my sec status in-game, it's -10) I can tell you that this happens an awful lot to me (everyone wants to take a shot at a red pilot).
Being podded doesn't actually affect me at all, other than putting me into a different station in the same system (I don't lose skills or need new implants or clone). Within 15 mins I'm back ready for action again. However, as was mentioned by the first poster, some of us are pretty vindictive. In fact, I make a point of adding anyone who shoots me down to my contacts list (just because I can), and if I happen to see them in a week, a month or a year's time in a vulnerable position, I may decide to destroy their ship and pod. I don't really care about the cost to myself - it's well worth it to see some smug git burn with all his implants.
In some cases I may even add their corporation to my kill list and pod a few of their players at will, then mail them stating the perpetrator as the reason for their loss.
EvE is a cold place. It's a great open playing field where you can do pretty much anything you want, but there are always repercussions when you tread on someone's toes, and that applies to me as much as to anyone else!

Works the other way too!
If your sec status is positive, try this. I used to fly around CVA low sec years ago in rookie ships. I was red to them and they always shot me and blew up my rookie ship. What they didnt realize was I now have kill rights on them. So once I got 50+ CVA pilots with killrights, I would camp the amarr gate and wait for killright pilots to jump in....killed alot of high value stuff....Great way to "reverse pirate."
