You trollin'?
WTF does an employment and services law got to do with an internetspaceship game? Absoultley nothing, thats what. Read the areas it covers ffs. Do you even live in the UK? if so you need to get some further education.
The game is a service.
No. A game is a hobby.

I'd say it's a product. And secondly, where does it state that disabled people can break the rules and not have to suffer from the same consequences as non-disabled? You'll need more than that in order to prove what CCP did is wrong. (and thats if we assume the story is even true)

Let's be clear here. The only kind of macros were are against are the sort that allow ISK farmers to fully automate their physical interaction with the Eve client to the point where they can do their dishes or do any other chore while their Hulk or Retriever is left unattended mining a belt on its own for hours on end.
You bought that steaming pile of **** in the OP? Really?
Really?
Probably not, I may not be able to rule out the possibility that the OP may be dishonest, but I also cannot rule out the possibility that the OP may actually truly be honest.
And besides, a couple of you have misinterpreted me. Don't forget that there are two kinds of macros. There are the sort that require physical keyboard interaction such as a customizable keyboard you can buy from Best Buy that let's you press a single key to tell the computer "alt+shift+q" or "ctrl+spacebar". Then there the sort that don't require your physical presence in front of the computer altogether for hours or even days on end (you'll have to search for them online on shady websites that are laced with spyware and viruses). The second sort are the kind that I hate the most.

Edited by: Spookyjay on 22/04/2011 21:24:20 Actually I believe technically due to the way EULA, MMO and Account ownership work and the way it is written. It would come under contract law as a service. It shares a lot of similarity legally with a service. Similar to line rental. Would be for the court to decide in the long run. But yeah in another sense a game is a hobby.
Fact is there are lots of dark areas with mmos and the law. And they get away with a awful lot of things a company with a store front never could. Because its this grey area all you can do is appeal to ccp in writing and send proof. hope they are willing to help. And if you feel poorly treated you can take it to either the court or the interweb for the rest of the world and potential CCP customers to decide on. Sad day though when you can not make a forum post like this without it being suspect of being a troll or it getting trolled by what has become a very vicious community. :P

I never said what they did was wrong, I already said I am not an expert on these laws just that they had to be careful and that even if these laws did say they were wrong I don't agree with them.

One more thing to the OP:
If your Husband truly is disabled to the point where he has to use macros to assist him on his keyboard, then I believe it is time for him to retire from Eve. I know how hard this is for him. I use to work at a clinic dealing with one particular patient that had to face a hard reality that he will not be able to drive his truck anymore. Driving was something he always enjoyed, especially since he owns his own business. But his caretaker and I (along with the doctor) had come to an agreement that it is for his own good that he cannot be driving anymore (needless to say the patient didn't like the news).
The same applies to your husband. I understand he enjoys it, but let's face it, he can't drive that Hulk anymore.

I'll give one bow to the potential that the OP is for real. Apparently, if he's been banned, something he did was deemed to be against the EULA. Since he's using macros, that could be it.. and since you care about him so much... how bout, when he plays eve, YOU MOVE THE MOUSE FOR HIM. IT would be a small price to pay for having what time he has left together, right?
Or better yet.. stop botting with your main and STFU.

Originally by: EVE has sound Macros like these are okay, because they are just user-assisting not automation. E.g. there are keyboards out there that have built-in macros shouldn't they be banned as well if it's not allowed?
It's not the keyboard, but the user who controls it. It is not allowed to automate gameplay with these functions. If you use keyboard for example to undock and warpto something with single click, that is automation.
Originally by: Ranger 1 I think you missed the point that this is simply a stealth pro-bot whine.
Agreed... if some1 was really disabled and could not play without some kind of special equipment, her/his main target wouldn't be public opinnion in forums. She/he would (or at least should) contact CCP directly and discuss with them about possible solutions. Eula is what it is and you agree to that when you start playing the game. End of story.

maybe you should try not giving the pubescent teenager attention, he will thrive on it since he is having so much trouble getting laid in RL. If you stop paying attention he will more then likely turn towards incessant ************ and crispycream donuts.
Ironically the weight he will then gain will only make it that much harder to get laid, which leads to more ************ and time playing eve. This viscous circle will finally end when he succumbs to a catastrophic myocardial infarction of some kind.
That being said...
How do you play baseball with a paraplegic? Go ahead... guess?

I will have to agree. La Dha, I recommend you spend more quality time with him. Rather then let him die slowly in front of a computer, it's best to do something else with him like reading a book or watching movies together, or taking him to places he always wanted. Being terminal in front of a computer playing Eve is not the sort of thing I would end my life with.

Edited by: Lanrick on 22/04/2011 22:16:52 Edited by: Lanrick on 22/04/2011 22:15:35 Well it could be a load of crap. The forums are not the best way to address this sort of thing after all. But people often don't know the best way to handle things especially if it is concerning that makes them really upset. Just because La Dha is an alt doesn't mean anything. Her husband plays the game. She never said she did.
Lets assume the best and that this is legit. Guy wants to spend some time in his last days playing a game that he loves. I can understand that.
La Dha. See if you can escalate the original issue with the GMs to a supervisor but that is unlikely to go anywhere. Better to contact customer service directly. Don't be mad. Don't get angry. If we can assume the best about your motivations then be willing to assume the best about CCPs motivations. Offer to send them documentation from your doctors concerning your husband's condition and disabilities. Ask them what can be done about this. As soon as they know that he is legitimately disabled I bet they will start bending over backwards to not only reinstate his account but also to find ways to make it easier to play.
But the trick is to not back them into a corner and force them to fight against you. Don't make them the bad guys. Make them they guys who have the opportunity to help a disabled vet. Stress the disabled thing and be ready to document it but don't do it threateningly. At least not until you have absolutely no choice.
If they will not help you at all then look into hunting down a civil rights lawyer that might do pro bono work on behalf of a disabled vet and find out more about the "Americans with Disabilities Act" at ada.gov. The ADA has ridiculously broad application. My guess is that it will apply in some vague way just like how large department stores have to have handicap access. But don't blow it off just because going to court is too much trouble or whatever. It will probably never get to that. The lawyer will probably just write a scary lawyer letter that points out the relevant parts of the act and CCP will respond by giving you what ever help you need. That is, again, if they didn't figure it out on their own before all this.
Just keep in mind that CCP is not a bunch of pricks. They just don't buy that he is disabled. Simply be willing to document it for them but also make it clear that you are willing to push the issue. Junior funkies don't care what happens to you, they just want the issue to go away.
Assuming, once again, that you are not full of horse$%!@. If you are, shame on you for just as much taking advantage of the disabled. ------- "The strong are often wrong but the weak are never free." |
