Second question - if they leave the fleet after I've started shooting them, will concord intervene?

Err... not sure, but... even if you are the in the same fleet, you can't shoot them in high sec. You have to be in the same corp AND fleet to be able to do that, right?

By report, do you mean have you broken the EULA/TOS? if so then NO, they can't report you. They will have kill rights on you if once you shoot them, and if they don't shoot back the entire time they will have extended kill rights on you for quite some time (15 or 30 days i don't recall).
If they are in the same corp, you can shoot them whenever. They DO NOT have to be in the same fleet.
Second question, which is more important. Concord will intervene as soon as you should them, if concord can intervene (i.e., highsec). In lowsec this applies to gate/station gun fire. Even in a fleet you pull GCC.
The ONLY advantage to fleeting someone is that you can warp to them/see where they are.

I don't know where all this recent fleet-member aggression misunderstanding has come from lately, but I suggest blocking anyone who is spewing this garbage.
It also LITERALLY TELLS YOU when you are making a fleet that it IN NO MANNER effects the response of CONCORD / changes GCC mechanics.
Where are you all getting this from? -------

In the off chance you arent trolling-you can do whatever you want to anyone in Eve at any time as long as it isn't an exploit, then sure they can 'report you' but their petitions will fall upon deaf ears as the EULA says doing whatever you want to anyone at any time is ok.
