Am I scamming. I read the rules and I don't think I am.
I am selling a tune. A guy made me an offer in mail but said it his offer would end on 2 days time. I replied by mail saying I accept his offer. I went to the forum thread and said I accepted his offer but as he put the time. I confirmed that unless i get a bigger on till that set date then he would have won the char. I never wrote he won it or told him to send me the money.
so i was expecting to wait till the date till I confirm the sale. the guy for some odd reason sends me the isk early even tho I said in the forum that the sale will end on that set date which it hasn't reached.
If I kept the isk, would that be scamming under ccp rules. As I did not lie about the char and did not ask him to send him isk. which is the common thing when you accept an offer. you have to say it clearly and ask for the isk to be sent. which I didn't
So if i keep the isk, am I breaking the rules or is the guy who sent the isk without a confirmation in the wrong.

I'm not an expert and it sounds like this person needs to learn how to read. However, I have sold and bought several characters and I do know that CCP takes potential scams of this nature very serious. There should be more information available from a CCP Dev on the character sale forums. In my opinion, I would return the money to him as a precaution. If he ends up winning you'll get it back. If you're wrong and he complains, you could get the ban hammer. Not worth it to me. |

I was in a similar situation earlier. Any kind of funny business that has to do with character trades WILL be corrected by a GM, you may face a warning if you aren't careful.
THere is a zero tolerance for this stuff. |

As I was not expecting to make a sale today and was planning on selling on the date he made. I stil have roles in the corp so i need to remove it. so he has to wait either way for 24hrs.
Also I am not asking in a moral sense if its right for me to keept he isk. I am asking in plain. if i was breaking the rules and if so does anyone know where it says that.

but where is the funny business when the buyer sends u isk when you say your still open for offers and the sale is still open. till that set date.

As far as I know it's not written anywhere but think about it for a second. Character transfers brings money to CCP, and if there would be a remote risk of being scammed of the isk you grinded, or spent IRL cash to get from buying PLEX/GTC it would mean BAD bussiness.
Trust me on this one, keeping the isk and not giving him the character is going to end bad for you. |

Send him his isk back if you don't like it. But don't keep it for "free" or the GMs will fix it for you. |

i am keeping the isk. I had all the intention to sell the char to someone. i was just being cheeky since I did say the sale was not over and for him to wait till the date he set and i was open for more offer.
since he didn't do that and I did not confirm it. I was being opportunistic in thinking i could keep the isk since he never followed the rules and send isk randomly.
I still have to wait for 24hrs. then I will send him the char. unless ccp tells me its not a rule breaking then I keep the isk and the char ;pp.
I did not go out looking to scam him but he sent the isk without a confirmation. its not like in game if someone wants to transfer the isk to his alt but then sends the isk to someone else by accident that ccp would punish the person who got the isk by accident. but maybe this is different here. |

well you seem you were all correct, ccp just confirmed it to me that even mistake will be corrected, so it would have been seen as a scam and ccp would fix it.

You will be banned for any scam that's even remotely related to a character sale. Even if you plainly state that you're NOT selling the character for the ISK that is about to change hands, and your scam victim agrees to that, you will still likely be banned. Just don't do it. |

Pretty much any mistakes made in the process of a character purchase/transfer can be undone by a GM if a part of the process didn't go as either side planned. So when your dealing with character sales just drop the whole internet spaceship dog eat dog act. Its not the place for it and im glad it isn't.
I managed to leave 2.5 bill in an account I sold. The other player gave me the isk back when he received it down the the cent. I imagine if CCP had to be brought in the whole sale would have been reverted but its nice if everyone can just work with each other with that stuff.
I also remember a thread from a while back where the same situation as in the OP occured and a GM did in fact tell him to give it back just as the entire community of general discussion suggested. |

i've completed several character transfers, and agree with the majority here that CCP would consider this a bad deal and make it right to the dude who sent the isk. ^^ seems like that's already been clarified above.
another thought on this topic:
Is there any other place in the game where CCP actually treats us like little children? eve on the whole is a cold dark place with very little forgiveness for mistakes.....except when it comes to character transfers.
i understand why they take this stance, but it's just funny to me that seems like the only place where they don't allow scamming.
A) Dude gets scammed out of 80B for a titan sale that never happened. CCP: "it's part of the game, u suck, can I haz ur stufz"
B) Dude gets scammed for a 1B cloaky scout alt. CCP: "OMFG, how could you DO that to someone???!??! BAN BAN BAN, give this innocent tool the isk back AND a happy ending"

Since you probably already sold the char to him (or returned his isk) , the deal here is he has the mail you received were you agreed and the logs exist from your conversation with him at ccps servers, you would have been the likely recipient of the mighty banhammer (some say it was given to them by thor himself) and he would have received the isk back. although ccp was not especific about your particular situation it does state that any and all form of scams performed with char sales woul be dealt with, no exceptions. so even if it doesnt specify your case it would still be a scam to their eyes and odin is unforgiving. |

You're forgetting that, unlike being scammed in-game out of a 80bn titan, when selling a char, there's actually RL money involved due to the character transfer fee. This alone could account for the descrepency in policy you cite.

If you keep it you will be banned. Simple as that. No lawyer **** on char bazaar. System is foolproof.
