Scenario was as follows :
Gang are mining a belt. Thief in small ship nicks loot and flashes red. He gets killed.
Thief comes back later in big shiop and attacks one person. That perosn sees him as Red, rest of gang see him as yellow and can't attack as Concord will pop them.
Should this have happened, and if so why ??
Very confused.

When he stole from you, he was agressed (ie. shootable) to you for 15 minutes or until he loses his ship. When you agressed him (started shooting him after he stole), you were all agressed to him for 15 minutes. He returns with a bigger ship, and agresses your gang mate. Since you've already used the "can agression" to kill him, only the people who he choose to agress can shoot at him.
Did that make sense?

Sounds like a loophole - an aggressor can lose a very basic ship and mean that a high value ship has to leave for the danger of him reappearing in a heavy fighter ?? Even when there is support who cannot help now ...
Big favour to the aggressors and ore thieves I think ...

Only if the miners chose not to shoot him as a group.
If only 1 of them fired, he just waits out the corp aggression then goes after the one that fired.
If the entire player corp fired on him, then if he came back, he'd have to deal with everyone. Alternatively the other members of the group can remote repair/boost the one being attacked with no problems.
The miners didn't have to shoot the thief to trigger agression, but equally if they jet-can mine without security, you're going to get thieves, so in a way, it's their own fault.

One important thing to remember, joining a gang only changes who can attack you. It has no effect on who you are allowed to attack. Corp membership has completely different effects on the rules of engagement than gang membership.

Actually, the ore thef don't even have to lose the ship. Here's an example (happened earlier this day to me). I was really bored and decided to make something fun. So i jumped into my bestower, undocked and ran into belts looking for some miners. Quiskly i found one, mining into the jetcan. Took his ore and when he/she warned me in local about the warning shot i replied "go ahead" - mined warped to station, i followed (looking for what'll happen). In about 30 secs he/she undocked and seconds later fired at me. I docked, waited out 30 secs, jumped into my pvp pilgrim and undocked. Miner had been gone, but i quickly found him/her in the belt. He was flashing red, and i believe i was still flashing red to him, though that actually didn't matter at that time. My ship was completely overpowering his/her cruiser. I decloaked and scrammed/webbed/nossed him/her, and ordered one drone to attack, which i soon recalled. I had no intention to kill this miner - that would be and unfair for him/her.
Later we had a nice chat in private convo and i've returned the ore i took :)
The morale is - be careful when ore thief has been playing for longer time than you - he/she might be just trying to provoke you for attack and then kill you without any penalties or concord intervention. I know there are some of this kind out there :) The kill right will let you to fire the first shot, your target will be able to fight back immediately afterwards.
