Yes I know without moderators this forum would degenerate. On the other hand I thought that, at least in the United States, the law was unmoderated forum = no liability for the company hosting it for the things said moderated forum = liability for everything that happens on it? Is this correct? Seems like a lot more moderation on the EvE-O forum than any other forum I've read.

It's only illegal if you get caught.

If your thinking about starting a game forum I would recommend talking to a lawyer in the field, he or she can help you out.
I'm sure CCP has looked at the issues and done what needs doing.

Yep...unless the OP is aware of the relevant laws in London and Iceland not to mention International laws that govern such things not sure how much can be said about this.
Even if you assumed US law on this where there have been some strange cases of liability stemming from forum moderation (and laws may have changed as the ones I remember seemed a bit of a stretch) you need to show damages. On the EVE forums not sure what damages you could claim. You can't be slandered/libeled that I am aware of when you are an anonymous Avatar here. Best you might come up with is recovering your subscription fees. If you played since EVE started you can't manage to break $1,000. Want to hire an attorney for an International case that will cost you years and hundreds of thousands of dollars to recover less than $1,000 (assuming you even had a case)?
