How do you know his members helped build the corp? For all you know the member in question might have joined a few weeks before the other guys left.
I know if some lameass stole my corp I'd be ****ed as hell, its MY CORP!
I agree with the OP, a player should have to go through the in game machanic to become a CEO, not just get a GM to wavedamagicwand

Corp are NOT a team. Members serve at the whim of those running the corp. Members are free to leave at shuch time they are no longer happy / making enough isk to satisfy themselves.
Corp memebers DO NOT have the right to petition GM's to take control.
If the CEO holds 100% of the shares and decides to "call it quits" from EvE... sucks to be a member of that corp. But it suck no more or less than a corp theft, contract scams or gate camping.
CCP should RESPECT the wishes of their customer and work within the rules laied out by their game. No shares, no vote, no ownership transfer.

Imagine if the 16 year old high school dropout from Burger King filed a motion in court to take over Burger King because the CEO of the company hadn't spoken to him in a few months.
