Ah I see now. So you aren't interested in the consequences of a differing policy, you just want yours. I hate to tell you but the world doesn't work that way. If CCP reimbursed every ship lost in a mission without verification then ship loss would be a joke - no matter what you could simply petition your ship loss. The fact is while it would have been nice to get your ship back, CCP can't do this because they need to verify every ship loss before reimbursing it.
