they have the right when they honor the lgpl meaning they can use the code but need to make the part public again (that's why they have to update the winex cvs)

But actually, WineHQ don't have the right to take Wine modification integrated to Cedega for integration with Wine.
This is the main diffTrence! If Cedega take that actual Wine codebase because he is superior in many point and do modification, not only they will have to put it public but also can't deny WineHQ to take these modification into Wine..
The DX code of Wine is completely different than the code in Cedega so Transgaming can't take a wine fix to apply directly to cedega without take all the DX part. After any modification to these part, this will be free patch for Wine :D
SO Transgaming have to keep his old codebase if he want to continue to sell his software without contributing to the Wine project.
PS : The Cedega "ship" have a big "leaking" problem and the "sinking" risk increase day after day! (Go to transgaming forum to see this. MORE than half subscriber have left if you check the vote rate...)

Cedega is NOT a sinking ship tbh. The company (Transgaming) is doing what makes good business sense to them. They are making deals directly with game manufacturers (CCP, EA, etc.) to build portability directly INTO the games for cross platform capability. If they depended ONLY on subscribers (@ 5.00/month), they would have gone directly outta business a long time ago. This is problematic for a small company in some sense as it appears they are abandoning support for the linux cedega application, but imho I dont' believe this to be true, based on the fact that EA and CCP have enough confidence in them to sign agreements to "port" their games. They have acknowledged (via Wulfie's blog on the cedega front page) that support for their cedega customers has suffered, and are in process of rectifying that.
They came up with a great idea to support games without going the way of LOKI, and appears that this business model will work. Understanding that the MAC platform is the bigger challenge and the bigger "pile of money" they of course will focus efforts there more. As they grow and file the rough edges off of this, we linux users will see benefits as they get the support and communications pipelines in place. Remember, after all, MAC is BSD based, and their development will in that regard directly benefit both the linux and mac platform as they are "kissin' cousins" in many architectural regards.
Not to get into a philosophical discussion over what's good/bad regarding wine vs. cedega.
