I would check your overview settings to see exactly what you have set as showing solid red as opposed to being set Flashy red.
Most people make sure their settings have the overview flash red only for viable targets in whatever sec you happen to live in. IE. Usually either war targets or under -5 sec status targets.
Solid red usually denotes people you dislike or should keep an eye on due to a slightly low sec status or unfriendly standings set by either your corp or alliance (or personal standings). But this does not automatically mean you can attack them with impunity.
Also keep in mind that the little black skull only means that he has a bounty on his head, not that he is automatically a pirate and therefore fair game to all.

Yellow players often show up as red. Uncheck the yellow player option.

Standings are different then security status..
If someone is flashing red on your overview, then he has global criminal or a SECURITY status under -5.
However, if he just shows up negative, as with a minus displayed next to his ship(which is also red) he is NOT fair game.
A corporation can set standings to any other corporation as they like it, however that doesnt give them the right to shoot them in highsec. ----

If he is flashy you can shoot. Tho one I know got concord'ed for it, and his respons from a petition was "flashy red does not mean you can shoot". SO I really do not know CCP standing on the issue :S.

Concord won't shoot pods. No NPC's shoot pods.
However, a criminal's pod is fair game to any player that can catch him.

global crim can enter hi sec in whatever ship he wishes barring caps cause theyre banned from hi sec. i used to enjoy shopping in empire market hubs in my nano claw when i was -10.
