Edited by: Dirk Magnum on 26/01/2009 06:43:05 Getting the thread back on track: Yay, so long as it's applied equitably, which in the US it is not. Minorities get sentenced to death at a disproportionately high rate compared to the number of white murderers, and men get sentenced to death more often than women (proportional to the overall numbers of murderers from the relevant demographics.) Some people don't need to ever be allowed back on the street, no matter how long it's been since they've committed the crime. If the courts can justify sentencing someone to life imprisonment without the possibility of parole they should just man up and order an early end to that individuals' life, allowing of course all due time for the appeals process.
I'm also not a big fan of the methods of execution most commonly used here. IMO electrocution, hydrogen cyanide poisoning, and lethal injection don't measure up against the ban on cruel punishment, despite what the courts say. Nitrogen asphyxiation would be a big improvement, since the body doesn't recognize nitrogen as a reason to go into a state of distress. The same gas that knocks you out at the dentist can be used to induce fatal nitrogen asphyxiation.
I believe that firing squads are still allowed in some states, even though I don't believe we've had more than one or two civilians executed in that way in decades. A couple of bullets through the heart is probably quicker and less painful than any other alternative currently authorized for use in the States.

Edited by: Irulan S''Dijana on 26/01/2009 06:58:14 Say what you will, but I quite like China's execution methods. A single bullet to the back of the head = quick and no mess. Everyone also becomes an organ donor which is an added + in my book.
As to whether we should have it at all, I'd say yes, but only for the worst of the worst. Not even murderers rate it imo, you'd have to do something really huge. Say...sell contaminated children's milk powder knowingly. Basically something that's really really bad, or something for which you simply can't be treated for/they can't lock you up somewhere for.
edit: Voluntary execution would be allowed if people really want. e.g. sentenced for life = screw this. Although this might have the downside of terminally ill people going around killing random people to get executed.

Main problem here is that society rams it into your head from an early age to be better than the person sat next to you at almost any cost, this is why for the best part I disagree with most punishments, with a drastic society change in the modern world we could prevent %90-%95 of crimes.
Look at your average politician today! What background does he usually come from? Usually a financial and/or law educated background! Now tell me how the f*** they are qualified to deal with today's society problems? The truth is that they can't, when people are stabbing each other in the street what is a politicians solution? They try to solve it by making a tougher punishment and that in my opinion is a complete and utter no brainer, the focus should be on crime prevention not criminal punishment, but as long as politicians only care about themselves, the super rich and law making then we will always be stuck with social degradation.

As for cruel and unusual punishments, i'm all for them. I have absolutely NO sympathy for any paedo feeling scared ****less before the moment of death, none at all.
Thats as right-wing as i'm ever likely to be. As a 'leftie liberal' i'm not supposed to be like that but I dont care.

I disagree that capital punishment is a deterrence to murder, but I do believe that capital punishment is a deterrence to crimes such as drug trafficking. Simply put, once you remove something from the realm of profit vs time, to profit vs death. The pool of potential drug traffickers shrinks significantly.
Even if not applied in such a manner, the death penalty is essential for prison function. Without capital punishment, a prisoner already serving life without parole has essentially been given a blank check to do whatever he wants inside a prison. After all, there's nothing more severe you can hand him, why should he be good?
Finally, about means of execution, forget bullets, gas, guillotines and the rest of them. Hanging is the ultimate means of capital punishment. It quick, leaves no mess( if done properly) and organs are all harvestable. Whats more its sustainable, re-usable, eco-friendly and if so desired can be produced organically (hemp rope). That should keep the hippies happy |

My views on things like that are very simple, I don't care about vengeance or anything, I care about the fact that some people are beasts and thus should be treated as such; put them down. Society would be a lot safer if it would get rid of people who commited really, really bad crimes.
Humans are still animals and the only way to deter some people from doing crap is allowing for more harsh punishments, people should be scared sh!tless and jail should be hell.
Re-introduce bodily punishment. Right now some see jail as 'cool' and are even capable of continueing their crap inside jail, others take a calculated risk (well, i'll take 8 months for this if I get caught, that's worth it). Lets see how cool it is or how one's risk assessment will change if they would come back barely able to walk.
I'm not interested in people who commit really bad crimes, I don't care for their well being, I don't care for being PC and I certainly don't care for trying to 'cure' them. For the simple fact that they didn't care for their victims and as such it's the duty of society to make sure it never happens (again).
Does this all sound harsh and completely loony? Some people might say so but I disagree. society should do anything and everything to keep beasts from making victims, what's the point of trying to treat beasts humanely. Thing is ofcourse that there's a whole industry based on it, jails, psych wards etc benefit rom treating criminals 'humanely'.
The longer they can hold those customers, the bigger the chance of them coming back after being let loose the better it is for this industry. In a lot of countries jails are actually businesses which, just as most other public institions, they should not be. Institutions who act in name/serve the wellbeing of the community as a whole should never have conflicts of interests.
And stupid crap like having/growing pot being a crime and going to jail for it is just wrong. The only reason why it's a crime is because everyone can grow it at home and thus the big wigs have no control over it which means they can't make cash on it.
Differenciate between the types of crimes and deal harshly with criminals who crossed the line severely. Anything else is either not being realistic or trying to cash in on it.

Edited by: Elliot Reid on 26/01/2009 10:45:41 Nay.
If we could guarantee that those executed were truly guilty then I'd have no problem with execution, but the problem is far too many innocent people have been executed and thats too much of a risk for me.
For anyone stupid enough to argue that sometimes mistakes happen and that shouldn't stop us executing people I ask, how would you feel if it was one of your loved ones executed wrongly?
I am from the UK and what I'd like to see is life meaning life. I always find it incredulous when you hear about someone convicted of murder getting life with a minimum of x amount of years (sometimes that x is a single digit number.)
Nay. Life should mean life as a wrongly convicted person still stands a chance of clearing themselves. A posthumous exoneration means **** all if you're dead.
And yes, we should stop sending people to prison for stupid things, there are other ways to deal with certain people, and drop this idea that prison is about rehabilitation. Also paedophiles should get life as I'm sick of hearing about kids getting abused by someone who has been in prison before for paedophilia. |

Edited by: Tzar''rim on 26/01/2009 11:08:48 Case in point; few days ago in Holland a 20 year old guy walked into a children daycare and killed 3 people (2 of them children I believe), while stabbing 15 others trying to kill them as well.
What's the point of trying to treat someone like that? Would you set that one free after a number of years in jail and psych ward, would you agree to him leaving next door to you while your children play outside? There is NOTHING that could convince me, no amount of 'experts' who state that after a while he'll be 'cured' and 'ready for society' again.
**** him, society is not ready for him. To me there's only one solution for people like that; death penalty. Thing is ofcourse that (as stated earlier) the whole industry around the penal system does not benefit from the death penalty, they'd rather keep him in jail for years and keep all kinds of experts, doctors and security busy.

Yes in theory, No in its current practice.
The death penalty could work, but due to the corrupt nature of the legal system as it is, the death penalty is broken due to reasons Dirk pointed out above. There needs to be a massive reworking of the penalty system for criminals. Meaning that we need to focus on the reasons why crimes are committed not the problems associated with jailing everyone that does not have the money for a good lawyer.
To the one that says executing drug dealers is the solution; buy a clue

Yay.
Some people would take so much therapy to get back onto the streets, and probably never would integrate back into society. They are a waste of taxes to stick in jail for their entire lives.
However, it needs to be fair and the crime needs to be sure. I am a strong believer that punishment needs to be quick and tough, so people are sitting around in jails less and paying back society more.

No issues with killing a murderer here. Only issue is that in a court of law reality gets a bit fuzzy. The judicial system is open for error and abuse. Death is too absolute a thing to be open for error and abuse. So no court of law should sentence people to death.
If you encounter a murderer in the wild, though, I have no issues with it getting killed. Sure you better be damn sure what you're doing or you'll get to jail yourself. But shooting to kill to save a hostage, no issues.
Actually anyone pointing a (verified real) gun at someone or threatening anyone else with a weapon-looking item should be executed on the spot.
Now hopefully IBTH.

Edited by: soldieroffortune 258 on 26/01/2009 20:42:07 yes, i endorse Capital Punishment
especially so if its something major, like being tortured to death, or killing a mother and her child, or had the victim been killed in a "less than humane" way shall we say way. . . . .
i also read someone elses post about voluntary execution for those with life in prison w/out chance of parole, i agree with that, less costs for me
i do however think they execution process should be sped up, ive read that it can take dozens of years for someone on death row to be executed, i must say, that is rather stupid, if they are sentenced to death and waste 20 years worth of our tax dollars to keep them alive
