if someone has a -9 sec rating, i presume its safe to attack him in .4 and under near gates...

yes, if he has a -9 sec rating, you can kill him in 1.0 and below....if he manages to avoid CONCORD and the sentries...but you cant pod him

what are the criteria to attack someone in empire space without getting in trouble with concord ?

If a player has <-5.0 then he's free game anywhere

Be aware though, that once you have initiated aggression, your target is allowed to fight back w/o sentries intervention, regardless of her/his security rating (this is a matter to consider upon 'criminal' ( < -5.0)encounters around stations and gates in 0.1 - 0.4).
