It amused me, it really did, didn't know that peeps were trying to get around char sales on ebay like this.
Granted it's not selling the character straight, even though we all know it is.
Where does CCP stand with this, are the 'free' characters still going to be banned?, too lazy to read the EULA.

They're not automatons (or lawyers, same thing). Obvious intention to seemingly circumvent character sales rule will result in the same punishment as a plain sight character sale. --------

I think the EULA now forbids even the attempted transfer of in game items such as characters. So it wouldn't matter if the guy would give it as a gift. If you accept any such offers, you violate the EULA too. The one exception is the legitimate character transfer system. So likely it is banhammer for all involved.

So, let's say I'm tired of this game and it's time to leave.
I Ebay my character for a grand.
Then I get banned from the game I am leaving with 10 C notes in my wallet.
I'm okay with that.

Everything in game is CCP property so they can delete the character or ban the account for whatever reason they choose.

Eh, they do have a service agreement with the account owner though, so it's not all that simple but the EULA and ToS are vague enough to allow some leverage. They only need to avoid violating trade laws. --------

Think again
Originally by: TOS 25. CCP reserves the right to close, temporarily or permanently, any userĘs account without advance notice as we deem necessary. Read the last sentence. As soon as they violate some trade law, they can toss the ToS. But that's the only limit. --------

Hey cool rules.
Now lets see how long they stay in business when they actually start applying them. It's a dangerous game when word gets around that CCP have started arbitrarily banning paying accounts. Whether justified or not.

Mr Epeen
But they are doing so already
The moon mineral exploit. That's quite arbitrary. Sure, it was an exploit, but who in the real world cares about that? What about people who gets banned for saying naughty words? Or maybe people who get banned because they baited people in a newbie system.
Those are all very arbitrary reasons for banning paying accounts.

Edited by: Kazuo Ishiguro on 06/02/2010 22:37:30 It is not unheard of for courts to dismiss catch-all clauses (in the manner of sections 25-26 of CCP's ToS) as being unfair, and to let people challenge the service provider anyway. This happened with Second Life on at least one occasion, if I remember correctly.
It's less likely to happen with EVE, because there isn't such a strong emphasis on buying ingame currency and items with cash, and because CCP is explicitly against people selling ingame assets for cash. --- 34.4:1 mineral compression |

Just create a petition and link all the char sales on eBay.
I have done it a fair few times myself and it is quite satisfying when you get a reply back that they will take care of it.

If you had really done this then you know full well that without some kind of clandestine and resource heavy (read staff that could be put to better use getting the stolen accts back in a timely manner for people, etc.) involvement from CCP, no one will be getting banned. There is no way to tell what character is for sale let alone who's acct it is without taking the time to contact each and every one of these people and then sending them the cash once you have won the auction. The likelihood of getting an API code or character link from any of them is near zero.
If you had actually looked at these ads you would be well aware it is being done by an organized group that is, no doubt, fully aware of what not to do to caught.
Your little bit of joy at hearing from CCP that 'they will take care of it', is just goofy.
So stop with the BS posts already

The joys of Ebay and the breaking of EULA's and ToS's.
You can many 'paperclips' on Ebay and I have reported a few in my time to CCP. I would report it to Ebay but they dont really care. If I was CCP I would attempt to purchase these accounts via paypal, ban the accounts then get my money back .. easier to do than you may think. Also, they (CCP) could reach an agreement with paypal BEFOREHAND and no money would need to be spent anyway. After-all, Paypal are also entering into a fraudulant exercise by passing the money from person A to person B if they are made aware before the purchase thats its stolen property. You only pay your subs for the right to play the game, nothing in it or to do with it is yours whether you play for 1 week or 5 years. It all belonging to CCP, oh yes sirree! If I was anything to do with CCP I would crack down heavily on ALL the peeps selling EvE realated stuff, even the EvE decals (have they a CCP license to sell EvE related merchandise?).
However, in all of the things on sale on Ebay (EvE related that is) are the poor saps who are willing to pay ś28 for an 'original' EvE game disc cover. No promise of the game inside and its not as though they are usable anyway anymore but what the heck, who cares right?

ebay never give any hint nor indication of any action, if any action is taken or will be taken, or of what kind of action is or is not taken. they merely respond to say 'we got ur mail'.

CCP will ban these 'free characters' as well. If anything, it's done more so the seller can avoid having the sale reversed by ebay with the "hey they got the paperclip, the character was a free extra" excuse, which ebay probably doesn't buy either.

Thought experiment: what happens if I list someone else's character on ebay/craigslist etc, with no intention of ever supplying it? If the 'sale' is reported to CCP, how do they determine what course of action to take? --- 34.4:1 mineral compression |
