If CCP realy wanted to stop the sale of isk and other stuff on Ebay its real easy. 1)Isk and other items are property of CCP.(int property rights procteted under law)
2)Ebay is making a profit off ebay sellers.(this makes them a party to actions)( Or even if they didnt take a fee for listing look at downloading of music IE: file sharing Law suits all won)
3)All CCP needs to due is file suit agaist Ebay for dealing in there property rights.(problem solved)
4)Ebay in the past, has had law suits brought up and they stopped letting peeps sell those items on ebay.
5)now the ? is why it still goes on, could it be that some of these ebay opts are run by CCP or those with conections to CCP.

2. Yes but they have little control over what goes up on their site. Its like when people sell illegal stuff (guns, drugs, etc.) on ebay, they try and stop it where they can but it often does not work. The absolute best you could hope for is them putting it on their 'prohibited items' list which IIRC it already is.
3. See above. A case based on something they have only remote control over is tenuous at best.
4. See above. Ebay already prohibits all items that infringe upon intellectual-property/copyright laws. But if theyre too swamped with the stuff to adequately police themselves, it wont do much good.

Go read the descriptions of the EVE items being sold. You will see that most people selling stuff have found away around the EULA. They are not selling the items or characters, they are giving them away for free. They even say that the items are the property of CCP. What they are charging for is the time they spent generating said items or characters.
This is a technicality yes, selling of someones time and giving the items for free as opposed to selling the items. I am not a lawyer, but IMO this satisfies the conditions of the EULA when that disclaimer is posted. In addition I agree with the other posters, I don't think CCP really cares too much about this as they have more important things to spend time and money on.

You stupid bastard. While it is against the EULA to sell items/isk for cash, trying to prove that people who do it are criminally liable would be nearly impossible. Getting a judgment that EBay is inducing said violations and should be held liable will be *completely* impossible.
EBay doesnt give two ****s about online isk sales when they're busy trying to stem the sales of illegal **** like guns, kiddie ****, and human organs. The only real option CCP has is to attempt to identify the accounts in question and ban them themselves, and that sucks down man-hours like a two dollar prostititue. I think CCP may have actually finally baned the munart characters, only took 3 months of petitioning from me, as I have had a war declaration active for 24 hours and not one of them has logged in
So either the banning or my war dec has stopped him macroing, either one is good for me
