Your test for whether something is bannable misses every bannable offence. Unless you somehow get banned for doing something that's impossible. The whole idea of exploits is that it can be done, but should not be because it was not intended.

Bombing Jita is fine, although they might give you a warning about large fleet battles given the number of people you're going to hit.

CCP created aggro mechanics, CCP created starter systems, CCP allows me to jettison cargo cans where ever I like and yet canbaiting in rookie systems is a bannable offence. Go figure

The rules regarding incidents like 'smartbombing jita 4-4 undock' are a bit relative, but not that hard to understand.
'Griefing' pilots by, for instance, smartbombing them, is allowed as long as there is some sort of gain for the player.
If gain is plausible it is legit. If no plausible gain can be established and the action is thus simply griefing for 'griefing's sake' then
CCP WILL take action if you 'grief' grief enough people that get upset or grief one/several people for a prolonged period of time indicating personal vendetta with no cause except ruin the other player's game.
This is my interpretation of the EULA as it stands, feel free to comment/rectify on my view.

Hello noobs.
Papa Lark is here to inform you of your errors.
The myth that smartbombing Jita 4-4 comes from the time when a certain corp blockaded Yulai and RR'd a smartbombing BS at one of the gates (in the time before warp to zero) while it was being attacked by Concrod (before agro rules were changed). It may also have something to do with Miz Cenuij's jihad on the ice miners of Jita (when there were still Ice Belts to be mined).
For anyone deciding to 'go massive' at 4-4 undock. You're in for a shock because it won't happen. You must be clear of the dock radius to do so. As Jita 4-4 is huge you will find yourself 30+ km from any ships you wish to explode. By all means try to snag a few at the gates or on approach but retribution will be swift and unforgiving. You won't get bannzored though.

the last person smart bombing jita, did it on the side where all the ships are landing from perimeter gate. there you would have enough room for it.
