Why can't capsuleers control the gates? Who operates them and why?
If a capsuleer alliance has sovereignty of the system, why cant they stop hostiles from jumping in?

I am pretty sure it's just due to gamemechanicsÖ. Else alliances could 'pull a Jove' and just turn off the gates and live in peace happy all after.

In addition why are there empire gates all over but only a few "smuggler" gates out in 0.0? It seems to me the opposite should be true, that empire gates would be fewer in places they have no control over.

Think it was something about early expansion that the empires couldn't commit to, also some of the 0.0 factions might have built them such as the npc's in the Syndicate region. Sansha (before he went all looney) built some stations etc so he might have built some gates as well.
On the gates and sovereignty, I think the gates are pretty much automatic in deep 0.0 and capsuleers can't access the controls or have the knowledge to do so. That might be why you can't build stargates, only jump bridges. __________________________

Builders of the 0.0 stargates would be likely divided into three groups: (1) Terrans and other first-wave settlers. These gates aren't really working, but likely could be repaired with some effort. This includes the Jove (who likely built a lot of gates into Curse and that direction, and then later to Geminate / Vale of the Silent) (2) Explorers and colonists from the empire factions. The Caldari tried to colonize Pure Blind, for example, and likely explored Venal. Imperial fleets explored Impass while trying to get around Stain for the tasty Nation underbelly that is Esoteria and Paragon Soul. Thukkers hide in the Great Wildlands. Fountain was a join colonization project - the first 0.0 region opened to the public (in fiction). (3) 0.0 colonists, outcasts etc., for example the smuggler gates.
It would be highly likely that a combination of CONCORD and the empires do fund the gates, and in return the gates work by their rules. A bit like Comstar in Battletech, they run the faster-than-light comms network and everyone agrees, because C* deciding to cut access to the network would be a Bad Thing.
Of course, capsuleers do control the jump bridges, which are a bit like gates, but slightly less advanced.
