As stated by CCP Oneiromancer The FFA beacons are not part of the test server rules. They are simply guidelines.

Unfortunately this is not conclusive evidence. What could have happened here is that the target warped to the FFA 2 beacon, got shot by some people, warped to FFA 3 and was then killed. Somerandom may simply have made a mistake in following him and been leaving just as the screenshot was taken. He may even have been fleet warped to a location he thought was something other than the FFA3 beacon. What this picture does prove is that he was in FFA 3, but it does not entirely prove his intent or fault in doing this.
This is further supported by the fact that somerandom was in fact not locking the target and was 180km away.
In cases that limit the rights of individuals, the most common way of interpretating laws or rules is in a narrow sense. Therefore if it be not proven that somerandom intentionally warped to FFA 3 with the intent of engaging in combat it would be a wrongful application of rules.
I do realize that these rules are entirely subject to the decision of CCP but in cases of permanent bans it is worth it to review the details carefully before making decisions.

FFA ship types are only guidelines and not server rules, the only rule that effect ship sizes in FFA beacons is rule 2 which mean capital ships wishing to "free for all" should only be at FFA2 and FFA2 only along with fighters and fighter bombers.
AFAIK it is very difficult to prove that the capital ship had any relevance to the kill as it is your word against his.

oneiromancer is trying to change rules that have stuck for 6yrs.....other ccp and bh/isds will enforce them guidelines ARE RULES. oneiromancer might say w.e to not hve to worry about it but others will dock/move u or ban u for repeated action...they did break rules.
