On the IGS Lyn Faryl (read post:26) proposed an interesting view that I hadn't considered before... yet which makes a lot of sense now that I think about it.
When an empire mission agent gives you, an untouchable capsuleer a mission... Is that mission considered sanctioned by CONCORD? And is everything in that zone thus completely at the mercy of the capsuleer without any legal recourse?
Somehow that seems very fitting for a dark universe like EVE. From one moment to the next an immortal deathmachine can swoop in to kill/maim/abduct you at a whim...
What are your thoughts? Am I trying to overthink this?

CONCORD sanctioning of capsuleers, in general and not just specific to missions, is the only way I see to square actions in EVE the game with New Eden the sci-fi universe. Why else would my main, a Minmatar faction warfare pilot directly responsible for the deaths of thousands of Amarr navy personel and Amarr militia volunteer crewmen, be allowed to dock in an Amarr navy station without hassle or complaint.
Which, by implication, makes all capsuleers effectively agents of CONCORD. Even those -10.0 capuseleers are protected by CONCORD, allowing all to dock in all NPC stations and clone without complication. And since CONCORD makes ISK from capusleers via tax and sovereignty fees, would make a very dark universe indeed.
(One hole in this theory - I believe payouts for bounties from CONCORD exceed payments CONCORD recieves. So in actual in game content, the capusleers are a isk-losing proposition for concord. But then if all the 'rat' activity in New Eden is taken as true, then the universe falls apart for other reasons anyway. So given a 'reality' of far more limited pirate npc activity than is presented in game, it still works.)

you also have to remember that some concessions have to be made for the sake of gameplay. this is why someone who is -10.0 can enter empire space because for gameplay reasons NPCs do not pod people.
In Lore it is quite reasonable to think that if a truly bad person showed up in empire, Concord would jam the clone frequencies and pop the capsule and be rid of a criminal for good.
Concessions for gameplay happen in all MMOs just to make them more practical to play, a Blizzard Entertainment dev gave a good example for their WoW game along the lines of Stormwind guards would never let a warlock's demon pet into the city since well its a demon. but for gameplay reasons it happens, just as that -10.0 sec status pod pilot could fly right into Jita in their capsule. that said at that sec status I can pop them without reprisal from Concord. but logically Concord would do it themselves in storyline at least. NPC kills are limited to ship only since CCP sees that as penalty enough when dealing with AI controlled units.

I agree with that in general, however the EVE devs so far have been big on players deducing (or just inventing and thinking they're deducing) lore from gameplay. For instance, the Sansha events when players 'located' Sansha in Jove space. Dropbear and associates have consistently refused to say "this is gameplay, this is reality, this is where they are different." Quite the contrary, Dropbear has made it a point of incorporating gameplay mechanics into the storyline.
So, I totally agree it's a gameplay mechanic. But that doesn't mean it's not also lore. I've yet to see anything in EVE, no matter how gamey, that the storyline Dev's have said "yeah that's just a gameplay mechanic."

Eve Survival has comments in some missions saying that you can get concordokken if you hit some of the structures with smartbombs, but can't remember which ones, or whether anyone has tested it recently. ______ Tippia's analysis of NEX/Incarna |

really from a missions perspective we are nothing more than our own personal "Blackwater", or simply mercs who do jobs for corporations that are sanctioned by the state. It also makes the pod pilots sort of disposable in that our actions can be denied by the state if the need arises.
