Mmmmmhmmmmmmmm... people be sensitive these days. Will be watching this one to see how it turns out.

"At issue is a federal law originally enacted to criminalize traveling across state lines for the purpose of stalking. In 2005, the law was modified to make the "intentional infliction of emotional distress" by the use of "any interactive computer service" a crime... In this case, the government has presented the novel and dangerous theory that the use of a public communication service like Twitter to criticize a well-known individual can result in criminal liability based on the personal sensibilities of the person being criticized."

It won't help. They will still come for you if you offend their delicate sensibilities.

By your own implication, any time anyone does anything anywhere that is governed by different law, best example being a different age of consent, they would be valid for rendition.
They aren't.
Hell, if you're going by that link they could and would do it even if this law didn't exist. _____________________________________ Haruhiist since December 2008

More feel-good legislation that, if it becomes law, would be abused.
None of this will cover the "persona management software" packages that the government is known to use to shape public opinions and believe me, they get nasty when you call them out. The operator hates actually having to manually post and don't know how to handle it when they do.
I can also see it now: criticise the police or a politician and they then have the ability to ninny about it and be like "ooooh! I feel theatened!!".
It's going to be fun when the non-centralized internet comes online and having a wireless router is akin to having a printing press in 1776(America) or 1933 (Germany). Then some sparks (and other things) will fly.

Actually, I think you missed it. They know it won't hold up in court. They're making the claim just to get the person's name out of Google. Once they have the name, then they drop the case, retaliate against the author via any number of indirect means, and let the author spend the money and time trying to prove that they were unfairly fired/demoted/suspended/harassed/whatever over the videos. (Or if it's an employee making the videos, they fire the employee for unprofessional conduct.)
It's much more evil since the burden of proof (and costs thereof) shifts to the author.
Quote:
When we asked about the more likely scenario, Balasubramani said, "I think they were trying to get at the speaker and they looked around for a statute that shoehorned their conduct into and sent that to Google and said æturn over the information.ö
Historically, Google and You-Tube are far more likely to cough up an anonymous animator's real name when there's a criminal case, as opposed to just an internal affairs investigation into some personnel issues.

I feel threatened by this law.
There is a reason the people of Europe ran the zealots out those many years ago, if you look at a map from the olden days there would be an X marking the US stating 'here be crazies!'.

That law has no teeth until you tie it with some form of 'all internet use require RL verification' legislation. Which is, of course, impossible (the internet just does not work that way).
Even if Google does hand over what they have on the person, its very possible the details are false anyway. Many SL users have dedicated Gmail et al accounts fully registered in their avatar names, just for branding purposes. And some use this to keep their RL details separate.
Also, the moment Google gives in, accounts setup for privacy purposes will simply pack up and leave. This makes me continue to wonder why the FSF does not offer their own Google-like services.
A much better approach would have been to tell Google to remove the content under DMCA rules.
