It's me again... ;)
Another issue was raised today that I need your reflects on.
I would like your thoughts on how far EVE-Files responsibility goes for the content posted on the servers?
I am not talking about copyrighted or other infringing material since you know my stand on that, but rather to the issue when posting of images/movies makes other users upset.
Earlier this day I received a mail stating that some images uploaded to EVE-Files broke the ToS an external forum had, images obviously showing things that the moderator of that forum did not like.
By removing such images I now realize that I immediate took the moderator (corp/alliance/whatever) side. Is this something that EVE-Files should be doing?
The next time it might be a screenshot of MAX's frozen corpse of which MAX clearly do not want people to see, should I care and remove or should I simply take no responsibility since the screenshot still follow the rules of EVE-Files.
Of course this only applies to content that does not violate anything that would not get me in trouble, hence infringing material or likewise.
Thoughts?

I personally think, that you should only remove items that are against your ToS or are actually very offencive to some people. That external forum surely had the ability to remove the links to the images to their site? Meh I dunno, but you shouldn't remove images unless they break your ToS, and thats that, you aren't responsable for everyone elses sites/forums whatever.

Well, the moderator of the other forum should just deal with things at his end. Remove links, warn ppl for posting such links, and so forth. It's his problem, not yours.

How can your hosting thing be hold accountable what someone else on a totaly unrelated forums links in his post?

Its a unmoderated service (unmoderated for me means you can upload freely).
And imo if its EVE related it should stay on. A corpse of MAX is shocking, and harms his reputation, but its EVE related.
If EVE-Files breaks the ToS of other forums, then its their problem, i mean you cant keep track of where people link what.
Also if I break a Dutch law, Germany can't complain (Germany is that little country next to The Netherlands for people that dont know )

1. Its your server and your rules. If you dont want it on your server, remove it.
2. If it is against the eve rules, ignore it and 1. will apply.
It might help if there is a guideline from you about things you dont want to have on your server. If you only want eve things like screenies, movies and forum sigs, tell us.

What about a disclaimer saying that EVE-files holds no responcibility to content uploaded to the site via members. Pretty sure there is a lawyer or someone studying it on the forums who could help you

To be honest, everything YOU allow should be allowed on it. Its your service. If some forum had pictures taken of it by a member and put those on EVE-Files, its not your problem, and not up to you to remove them. (Assuming its EVE related ofcourse) The moderator of that forum should solve his problem.

Just trying to take over MAX's forum whoring ;)
And thank you all for your comments, I have decided that I will go by my rules and thus not care if the file(s) violate other forum/sites ToS unless the file itself is not following EVE-Files rules.

Perhaps it helps if you decide now about what you think is acceptable and what is not and why.
Personally I wouldn't host movies that would cross the bounds of game into more real life areas ( think of real pictures or personal information)and it would depend what those images of a website would show.
Goodluck on deciding, I'm sure its not easy
