Well an exploit being a way of doing something that the game didnt intend you to do, then i'd say yes it is an exploit.
After all if you was ment to land on the gate then there would not be a default of 15 km when you warp to something.

they've said a long time ago that insta's arent seen as exploits. altough they are looking into ways of removing them

Nope. Read the new player's guide. It specifically details a use of bookmarks as setting them 15km behind something to warp directly to it. Not an exploit.

If insta's are no exploits, since it is part of the game-mechanics then why is reforming a corp under a new name (also part of game-mechanics) to avoid a war by so many considered an exploit ?

There are, in essence, two possible definitions of "exploit."
Firstly, doing something in a way that wasn't originally intended, or envisaged, by CCP: insta-jumps clearly qualify on this count.
Secondly, and the more common usage, is doing something which a way which is not only unintended, but also expressly forbidden: that's what gets you banned. CCP have said pretty much all along that they allow instajumping, so, as with jet-can mining, it's an unforeseen habit that has become acceptable.

Well... ahem, all exploits involve game mechanics (which may be correct 'features' or bugs). This is something people, very curiously to my way of thinking, lose sight of a hell of a lot.
The question is: is a given use of a given game mechanic (feature or bug regardless ) an exploit?
Answer: it is if CCP say it is. (Again, something people often lose sight of, equally curiously, and often regard as outrageous, which is simply bizarre.)
Anyway, the classic, platonic ideal of the 'leaving wardecced corp and rejoining at later point in time exploit' is haulers leaving the corp, doing a run, getting safe and re-joining their corp. That is a flat-out cast-iron exploit as CCP have stamped on people who have done it.
From that clear exploit, loads of people have taken it upon themselves to broaden the definition of the 'exploit' to the ridiculous proposition that leaving a corp (or even disbanding it wholesale) because it has been wardecced is an exploit. It isn't.
Another example of a game mechanic that is a clear exploit is the old favourite of a corp trying to stop an alleged corp thief from leaving by reinstating their corp roles repeatedly. Again CCP have indicated by word and deed that this is an exploit.
Instas, while a questionable use of the game mechanic, are not only not an exploit (as CCP have not indicated they are or, except possibly in the very dim and distant past, punished anyone for using them) they are in fact recognised by the dev team to be so essential to EVE that they have indicated they will not take steps to curtail the mechanic in use until they can come up with a satisfactory replacement mechanic.

BMs havent been nerfedt yet so no its not an exploit.
thats my personal opinion.
BMs are still working (apart from certain routes)
untill CCP comes up with a solution to help travel times contra insta jumps then i wouldnt expect a thing to happen.
not a second before.

why not just look in the help files made by ccp?
In the help files it tells you how to make an insta to a gate.
Thus if they gonna tell you how to do it in a help file I would have to say no it isn't an exploit.

There is nothing magical about an instajump! It's just a bookmark to a location in space!
One may as well say that an instadock is an exploit. Many Gallente stations have such a large model size (50+ km across) that bookmarking the station location creates an instadock from anywhere in system by default.
One may as well say that bookmarking past a jet can rather than the can itself to dewarp haulers right on top of the can, is an exploit.
If CCP was really that bothered about instajumps rendering players invulnerable on long journeys, they would give all stargates the properties of small warp bubbles. But they haven't. So people can point dramatically skywards and yell "Exploit!" all they want.

Although they did experiment with doing that to 0.0 gates at one point (Que "dislike " of the idea by people trying it out and the development of the mobile warp disruptors ) . ----- Apologys for any rambling that may have just occurred.
