First off, the laws of EvE do not reflect those in America - or just about any other RL location. Please tell me a place that I can go to steal valuable materials that are being mined, right from the spot that it is being mined, and the people who are mining it have no ability to stop me from doing it, the cops dont care, etc..
So, on the subject at hand, I am a POS owner and I agree that POS's should NOT fire on neutral pilots in ES. I've lost a ship myself due to a new POS owner setting their station up to shoot anything that moves.
Should there be a Sec status hit? I would say 'yes' to that. However, to avoid the obvious 'lets go to the station a few hundred times in a shuttle and get the whole corp standing to -10 while they sleep' problem, a few things would have to be put in place.
1. No single pilot, or single corporation of pitots, could cause more than 1 'security hit incident' to a corp at an individual POS.
2. No NPC Corp affiliated pilot could cause a security hit at all.
Following these two 'rules' would mean the POS owner's fear of waking up one morning to find themselves at -10 security status would be avoided.
As for the actual security hit itself, I would treat it the same as using a pilot driven ship in ES to fire on a non-warring pilot. Give the hit to every pilot in the corp.
This also brings up the potential for a new skill... or a use for the current 'Starbase Tactical Officer' skill.. Use it to reduce the actual security 'hit amount' that the POS owning corp members would take.
Alternatively, the skill could be used to determine the settings that the POS owner could set on their tower.
I.E. A corp without a Starbase Tactical Officer could not set their POS to fire on a 'visitor' unless they were at war, or an act of aggression was committed.
A corp with a Starbase Tactical Officer (or whatever skill would be used) who had the skill at level 1 could set the POS to fire on anyone with a -6 or lower status. Level 2 would allow it to be set to -2 or lower. Level 3 to +2 or lower. Level 4 to +6 or lower. Level 5 to +10 or lower.
Of course this means that someone in a corp is going to have to take the time to learn the skill, but just about everything else in EvE requires a skill of some kind to accomplish.
If the 'visitor' was an aggressor, or was in a warring corp, then by all means let the POS turn them to interstellar debris. But the average pilot who happens upon a POS should not be automatically fired on just because they are 'in my yard'.
All this is just speculation because the amount of time it would take to code changes like these probably outweigh the time that CCP has set aside for making changes. In fact, the POS related skill sets that have been available for many months still dont work - so adding more skills, or adding to the 'duty' of an alteady existing skill - probably wont happen either.
