1. Will the Gang you are in be able to perform the kill as well? We often mine with a cover and so the cover should be able to perform the kill even though he did not mine. Should it only allow gang members in the same area to kill, or anywhere in the system?
2. Will there be an indication to the gang/miner that there has in fact been a theft and they can engage?
3. Will the ore thief be able to defend himself once he has been flagged? If so, what if a killer battleship decides to steal one piece of ore, and then wipe out the whole gang mining/covering?
4. What use is this system if the ore thief can just warp in, steal the ore, and warp to nearest station and hide. He's be from the mining field before you could even target him. Will there be some sort of penalty to as soon he can warp after stealing some ore, like say a few seconds?
5. If this free kill is time based, what happens if you chase him for a while and get him on a chance encounter just as the timer is about to run out. You nearly have him dead, and he's saved by the bell. Will you still be able to kill him or will Concord come get your ass?

1. I doubt it. If you have a guard, have them drop the initial can so they can engage any thief.

3. Yes. Anyone can return fire after being attacked. So a killer BS ore-thief could vapourise whoever fired at him. As for the whole gang, you can only -return- fire freely, so attacking the rest of the gang = CORCORDOKKEN
4. Repeat after me. Don't mine at the warp in point. If a thief is appearing from warp close enough to steal ore, set up some other instas. If you see them setting up instas for your can, you should have time to haul it away.
5. If the timer expires during combat, you can finish the fight. CONCORD only responds to initiation of fighting.
6. Nothing, occupation hazard of thievery.

I don't know whether it's on the test server. My responses are based on knowledge of the current aggression system and CONCORD responses.
Currently, to the best of my knowledge, engaging one member of a gang does not entitle the rest of the gang to attack you.

even on some of the better set up haulers (nano's in lows) they still can be locked and scrambled by everything bar a badger 2 before they warp
