This has been adressed in numerous threads, and it shouldnt be necessary to repeat.(do not take this as flamebait to go into the I-want-a-search-function-on-this-forum debate)
Same names, or very much alike.
All chars made almost at the same time.
NPC corps.
Does not move for 23 hours.
Does not talk.
Does not respond to invites.
etc.

well, what about it  
the only barge kestrel ganks i got involved with (on an alt) were in 0.9, and half an hour later, the alt i used undocked and flew back the field in a new kestrel to see what was happening.
i sat and watched for a while as the poor macro-monkey's macro warped between the station and field in his pod every ice-miner cycle time. in the end i used the alt to PK him to stop him coming back.

Why? Ore thieving isn't illegal. And if you aren't absolutely 100% sure, you shouldn't petition. However, you SHOULD do everything you can think of to find out if the guys you're watching are Macroers are not, and if you determine such, petition them then. Spamming petitons takes the GM resources from finding the actual ones and spreads the GMs "thin".

if he takes their ore without petitioning he will be classed as benifiting from a macro hence always petition first

Please keep in mind that not all miners are macroers.
Yes there are still some of us that get our rocks off mining all day.
Also, keep in mind that a strip miner has a 3 minute cycle time so if ya convo the guy and he doesn't respond imediately give him the benefit of the doubt and just wait a few minutes for him to put the book down and check his hold.
Trust me when I say that no legit miner wants to lose a large barge kitted with T2 strips. Besides, you'll be hard pressed to find a macro miner mining in a 0.5-0.8 system with a full T2 kit and T2 mining drones so bring along a scanner to check. Macroers seem to take the cheap way out and can't be arsed with swapping out mining crystals. So if you run up on a afk miner using drones and crystals theres about a 99.9% chance that it's not a macroer.
Unless it's blatently obvious please don't assume that every miner you run across is a macroer. There is still alot of us legit miners out there.

If they ban someone for ore theifing from macro guys when theres hundreds of macroers still out

They are not always big operations.
I decided to look for myself in Amarr last night.
Loaded my Omen's lows with cargo expanders.
First belt, I found two Prophecys mining with and iteron just sitting there.
Not to odd, so I go steal from his can.
I was able to make around 7 trips in my Omen and not 1 peep in local or private convo.
"Okay lets see what happens when I grab a bestower."
I park next to his can and the iteron driver convos me.
"Please leave, blah,blah,blah. Not gonna happen unless you pay me 1M isk." Thats when I notice the BC pilots havent said 1 word and just sat there.
Ahh an Iteron driver and his two Prophecy macro bots.
So I petition and have about a 30 min convo with this guy.
You know thing is, I was having fun chatting him up, he was a good sport, hell I even made him cry ("_*). Didnt call me names once even though I sat by his can for 30 mins and kept him from mining, and stole about 1M worth of minerals before that.
Its a shame I had to petition him. Because he was a nice guy and not the boogie man, even tho what he was doing was wrong. (isk farming with 2 mining macro bots.)
Ohh well let the GM's handle it.

You've got free reign to steal from WHOEVER you like, because there have been quite a few high profile incidents where CCP have just said "Its part of the game", yet you face a ban if you do it to someone who breaks a rule of the EULA?
HOW THE FACK DOES THAT WORK?

Selena what they mean is; if you know they are macroing or think they are macroing and you dont petition but keep stealing the ore you're taking advantage of the of the fact that they are exploiting (stealing ore from a person macroing, without petitioning it you could get into trouble.)
Think of it like a person who finds a duping bug, and your buying the minerals from him at a discount and you know hes duping but dont report it.
It means you both are exploiting.
He may be doing it, but your taking advantage of it.

To sum it up.
If you even think they are macroing, give a detailed petition and then steal to your hearts content.
I should add if they were found to be macroing, CCP may take that ore back.

Anyone buying ore/minerals on the market are benefiting from macro miners. Anyone buying something build with cheaper minerals are benefiting from macro miners. Ban them all?
Those two barge pilots that didn't respond in one of these posts could have been alts and the main doesn't bother to get into those accounts except to move ore.
One of the possible ways to find macro miners is putting up buy orders for ore and minerals and then finding that the same persons hands you ore every few minutes. And then in not stacked piles of ore. (Resulting in more market fee for them but they don't care). And when you go to check out their operation which has been going on for 20 hours the barges log off when someone else enters the belt. And the haulers dock and don't leave station untill you leave system again. Upon which they commence again. And if then one of those pilots is named XiaoFeng then you have a high chance that this is the dude selling isk on ebay aswell.
But hey it's a possibility. I'm sure CCP has thought about this aswell.

maybe ore theives is a good way to stop the macro... steal from them and see if they respond because any player would if u touch their stuff
