I have asked around in game and have not gotten a clear answer, so i now turn here.
Is this skill functional. By functional i mean does it actually DO what the description says, thus allowing contraband running to be a dangerous, but very fun and conceivable aspect of play. Or is it non-functional and a waste of character path/SP?

i too have been looking into the poosibilities of moving contraband around empire space, maybe using covert ops. but am unsure how viable this would be looking at the limitations on cloaking. is it possible to dock in a station, or jump gates while cloaked ? some agents offer a lot of isk for contraband items so surely there must be a viable solution. it could be a lot of fun running drugs, hopefully as profitable as it is dangerous.

I met someone the other day who had an agent mission in Caldari space where he was required to get a large quantety of "small arms", which are illegal in Caldari space.
This would lead me to beleive there's a way to get the contraband to this agent either by the player or by a gun runner who puts them up for sale.
Or it's a bug... I beg a GM or someone else in the know to get clarification on this please!

My friend got ganked twice by customs trying to run that mission. For a noob mission, it's pretty lame as it's almost impossible without some considerable skills. I have nearly 3m sp, giving me a considerable advantage over a noob and even I couldn't do it. Either there's a specific way it has to be done that even the agent isn't going to tell you or it's an oversight in the devs mission creations. It can be done with an Indy and a small secure can but this mission could be taken while someone is still on a 14 day trial so it wouldn't be possible to get an indy anyway.
As for black market. I'd skip the skill unless you want it for other reasons, buy a small indy and put a secure can in it. Even customs can't scan inside a secure can... yet. Since I'm not sure if this will be changed with the Kali patch. There's always chages that we are not told about in these patces. Like the marketing skill, it has a purpose but be sure you really need it or it's just wasted time.

What skill are you talking about? I looked under Trade and Social and couldn't find anything even resembling black market trading.

Its a character-creation only skill available down one specific branch of options.
As far as I know you can't put contraband into containers either. Its likely the agent isnt asking for contraband at all if it is simply a normal mission, but a variant of it like High-Tech Small Arms check the descriptions.
I have tried testing this on the test server but it seems the contraband just inexplicably dissappears after a long boring haul into empire space. So who knows if the skill or the implants do any good.
If you dont care about your faction standings you could also just deck out a fast ship and use instas. Its happened to me once or twice by accident that I have gotten the message to give up my illegal goods but I just warped away before they could lock me down.

It was unintentional. I had looted it and forgotten about it. I got away with all *OMG* 10 units of the stuff back to a station and docked.
I took a standings hit though which sucked. so if you wanna run drugs kiddies, use and alt and a fast frig loaded with nanos and have instas.
The place they almost always get you is when you warp in at 15km to a gate. They warp scramble and web you and then kill you sometimes even if you give them the drugs. But if you warp quick enough after you uncloak you can sometimes get away even if they catch you.
Finally, since you can't place illegal goods on market in Empire, and have to go way out into 0.0 to buy them.. its kinda pointless unless you have someone pre-ordering with you.

Not allowing illegal items to be placed on the market seems a little dumb (no offense to whoever decided that).
I guess you'd just have to you escrow. I'm pretty sure there's a way to set it so the items on escrow are open to any player willing to pay for it.
Dang it, put these pro-smuggler features in!!!!

There is an implied way to smuggle in EVE. If there weren't, contraband goods wouldn't exist. So, if we assume that there is a way to do it, all we have to do is figure out how. I've seen mention of a Black Market Trade skill, which I assume would boost your ability to slip by customs officers, but I can't find it listed.

You can only get the Black Market skill at character creation...

So that's why I have had it as one of my characters skills but never found it on the market. That sucks and seems to me like CCP had a use for it once but decided to get rid of it for some reason but never updated the char creation in their patches.
When I tried it and maxed it out to lvl5, it did nothing. I had no more luck than any other character trying to get past customs, no extra areas of the market were open to me. From what I could see, it was a completetly dead skill and a waste of training time. Maybe someone who has used it for it's intended purpose can enlighten us as to what it really does or if it actually does anything now.
Unless it's possible to get a good standing with the NPC rats so you can use their stations and buy black market goods to trade with other NPC rat stations. I Didn't try that one but my char has gone to the big recycle bin in the sky now.

From the last Dev statment I have seen the Black Market Skill does _NOT_ have any current effect in game.
When the skill is released (Skill Books from agents probably) it will be implemented but my understanding right now is it has no effect.
You can "smuggle" goods now, but you have to use insta's and have a friend scout the gates before you jump them. usualy you can avoid the custom agents by picking your route carefully.

There's an idea there, with the friend scanning the gates. Something like a Jump Drone would be cool, for the lone black marketeer. Launch it, point it at the gate. It jumps out, and then jumps back with a report about what it scanned on the other side. Just a list of what ships popped up in the local objects window.
That could be useful for all kinds of stuff.

Smuggling is ridiculously easy all you need is a multi million isk cloaking device
i loaded up my badger with illegal goods and fitted a cloaking device
as far as i know concord doesnt scan you on the way out, but i cloaked and alined just in case
then i dropped my cloak, warped and cloaked again immedaitely on reaching the gate i traveled under cloak until i was within jump distance then i jumped ] repeat on other side
im not sure if i had the things in cans, but in eighter case, in order ot move stuff, you need a cloaking device
i have several mass small arms runs under my belt and a number of small quantity drug runs
the reason is that some agent offers require you to give them illegals in order to cash out ---------------------

Well, it's a long way off for new players but a cloaking device probably would be the only nigh-fool-proof way to slip past customs. If they dont see you, they cant scan you.
It feels like kind of a waste now, the having BMT. Well, too late to go back to char creation now; i'm too attached lol. I hope the decide to make it functional soon, but i wont hold my breath...
