If splash damage is this recognisable, how about limiting CONCORD's response to it?
For example, you launch a missile at a war enemy and they MWD towards a station with the missile happily following them like a lost puppy. Unfortunately, this puppy is carrying a payload and hits the station. This gets you killed 
Instead of CONCORD getting all argumentative, why don't they just deliver a warning to you stating "Joshua Calvert, your missile hit STATION X. Desist from firing missile in this area or CONCORD will respond".
If you hit something with splash damage again, CONCORD come in and mop the floor with you.

except in asteroid belt but that usually isn't fair combat... usually mining frigate or cruiser against attacking cruiser battleship.
And it make sense it doesn't happen anywhere else. I say that each solarsystem has it's own police that reactes according to their benifits __________ Capacitor research |

For splash damamge that hits someone by accident and they wren't locked I think there should be a better system than just being killed by Concord. Like if your flying around and a fight gets near you, someone's missle or bomb hit's you with splash damage a message should come saying, "Splash damage has occured by so and so and doesn't have you locked, do you wish to alert it as a hostile action Concord?"
That way at least honest people will turn done the action of concord. You would also have so many so many second to respond, so you don't have time to communicate to the person to blackmail him or her to not click yes.
If that system is a problem, do the opposite and message the person who did the splash damage. Saying something like your actions are causing damage to civilians in this area, cease your actions or we will consider you a hostile target against so and so.
Any weapons launched before that message that have yet to explode won't count as further hostile actions, only what you fire after the message has come up. Tht will fix the problem if a second missle is heading to a station and such. With this system, your protected against people who would also fly into your splash damage repeatedly on purpose, it gives you time to stop. And they don't get the option to call it as a hostile action to concord like my first suggestion.

And a msg that says "continue on firing a neutral/friendly target? Yes/No"
The second missile/s with a payload will self destruct if you press No and you had fired several missiles in the vicinity of that object.

If a missile does not collide and it has flown as far as it can after it's launch, it will be imploded and will cause no damage. This should help prevent accidental and unintended splash damage Sigs suck |

Why should CONCORD turn the other cheek when you kill innocent bystanders by firing off weapons of mass destruction without consideration? If you're firing missiles in civilized space and wind up damaging a station or non-combatant ship, you're obviously either a terrorist or a dangerous idiot and need to be removed from space.
And "That way at least honest people will turn done the action of concord." Huh? Why should I just shrug and let it go if some idiot is lobbing missiles around and winds up hitting my ship with one? I got shot but I should just let it go because he wasn't aiming at me? Excuse me, no, I want the dumb bastard blown out of space for my own and other's protection.
Moral of the story: Corp wars in civilized space are low-grade conflicts. You don't get to pull out all the stops and start nuking everything in sight just because you see a bad guy. You cause collateral damage, you pay the price. You want to use scorched earth tactics, take it to 0.0 space.

This happend to me as well in an asteroid belt about a month back. I lobbed some cruise missiles at an enemy NPC cruiser and slightly "blasted" one of my corp friends bestowers. Concord was all over me in a flash and only microwarp drive saved me from destruction.
I agree there should be some kind of recognition (especially if its your own corp) in regard to splash damage.

You should be able to shoot your corp. members as much as you like without retribution from CONCORD.
I regularly test out weapon setups on fellow corp. members and vice versa.

You use missiles, know the risks. I think it's pretty good tactics for someone to maneuver so the station takes the hit.
