If not what is the largest fighting ship that can operate in highsec?

Freighters and Battleships I suspect... assuming its not built and trapped in the system.

Carriers cannot currently go above 0.4. No capital ship can (freighters aren't cap ships). Oveur has said that in the future carriers may be allowed there.
So the biggest high-sec fighting ship is a BS.

Edit: Out of interest, I presume that means they can't even be built in highsec then. So it's a POS or mothing.

No, Dreads and Carriers (not Motherships) can be built at any station in 0.4 or lower. Motherships and Titans are the only ones that need a POS.

The interesting thing then is that the Empire Navies are probably weaker than PC alliance navies - while the Empires might need a few capitals to patrol their low sec systems, capital ships are pretty useless to them. They cannot even use them to attack the worlds of their opponents. Thus, I guess they don't have many of the things while PC alliances, who can use them anywhere, attempt to field as many as they can.

Not worlds in high sec anyway (although they have been used in the event a while ago), but the Factions have a device that the PCs don't have access to - jumpgates. If they decided to blockade another system, they could just shut down all their jump gates to that system. Yes, capital ships can use cyanosural fields, but you need one ship in the system in the first place to create the field and how is that ship going to get there if the jump gates are closed? Spend the next few hundred years flying at sublight?
