I'm a happy miner; mining scrodite into a can in a 0.9 system. All of the sudden a battleship comes up and grabs my can. (So now I can attack him, but in my navitas with mining lasers??)
He then jettisons another can and starts provoking me into taking back the ore. I know as soon as I engage him or take back the ore he can destroy my ship.
So here's my question, is there a way that my guild mates can help me out? I'd be happy to engage him with a gang of frigates, but not alone.

PS. I doubled back to get the cargo, but the lamer hadn't even put the ore in there. I also got a corp battleship to join me. When the guy showed up he all of the sudden didn't want to fight.

if you are in a player corp, anyone in your corp can shoot him for 15mins after he steals.

Really? I wonder why the battleship guy didn't open fire? The ore thief was still attackable for me.

I assume that "battleship guy" is your corpmate. Maybe he wasn't aware of the rule. Or, maybe he was chicken.

personally I think this is a fault its still your ore and you shoulnt get flagged for taking it back.
If some one steals your wallet and they get caught then you get your wallet back (posiblly a bit lighter than when you last saw it) and you arent flagged as a criminal.
It just enourages greifers.
Ore theifs should be able to steal ore, greifers shouldnt be able to exploit it to attack noobs.

I'm going to guess you're in a noob or other default NPC corp not a player corp. The 'attackable by corpmates' rule doesn't apply in this case (no I don't know why). I'm not sure if it applies for gang-mates or not but if it does I'd imagine they'd have to ganged prior to the theft.

My favorite thing? Pirate stole my ore and blew up my ship. I came back in my fighter ship, and he was gone, but he had a can there(I knew it was his). Was too much stuff(my stuff) in there so I thought I'd blow it up before he came back to haul the contents away. To answer "my favorite thing", my security went down as I shot his can. Hehe 
Shouldnt you be able to shoot cans belonging to people with low security?

The problem (assuming it really is a problem and not just a minor fly in the ointment) probably originates in the fact that things aren't identified and tracked by owner. When goods change hands ownership instantly changes hands as well, whatever the mechanism of changing hands (whether by sale, theft, etc). So, when the thief steals your ore, it becomes his ore. Not because it's just but because the database can't tag it as yours. If the pirate blows up your ship your stuff becomes his stuff, so that when you blow up your own stuff you're blowing up his stuff, again because the database doesn't have any way to tag it to the original owner. Such tagging, I would guess, is impossible without creating an intolerable lag as all this stuff is tagged and tracked through multiple owners.

Yeah. The fact that miners have to get flagged to retake their ore is bit meh. But as you say is very difficult to implement. You cant have each unit of ore an assigned owner, and managing stacks with multiple ownership in a single stack would be nightmarish.

In EVE, possession is 9/10ths of the law. You can only truly keep that which you can defend by force.
If someone can take something from you, it's no longer "yours" and your only recourse is to take it back by force.
Fit a hauler for battle and bait an ore thief some time. When you take back your ore and he attacks you, scram him, web him, nos him and open fire with the biggest gun you can fit on it. This has been my finding as recently we had some thiefs try and steal ore. Previously I saw that when someone stole only the owner of the can would get agression rights. (also i belive that it only works (gives others agression rights) if the can is created after forming the gang).

You know what I would have done?
Laughed at him. Tell him, in the most sarcastic manner you can muster, what a big, powerful boy he is. Ask him if he would like your civilian mining laser and that you would be glad to let him have it. Maybe offered some 'friendly' advice on how to survive 0.0 space. :D

I got a better idea...
don't mine into jet cans...in high sec space...
use securable anchored containers --- then your pirate ore thief crap goes bye bye for ever....to never return...
your own laziness brings on this action....

IF you are going to mine into a jetcan in high sec, have someone there to haul for you. just leave 1 cheap item (like a civilian shield booster or something) in the can to keep it open. As soon as you drop the ore in the can, the hauler puts it in his ship. I have 2 accounts so I can do this, and have never had any ore stolen. Another thing to do when you are doing this, keep jetting cans with 1 piece of ore in them, so that you have like 6 or 8 cans around you, so you have more time to keep your working can clear when the ore thief is looking through all the cans with 1 ore in them. >>-------------------------<<

Or, he just scoops the whole can into his hold, because you can't anchor them in 0.8-1.0...

The secure, one-account, one-computer, solo way to mine without worry for ore thieves is to mine in .7 space with a whole string of anchored secure giant cans. I've got one system tricked out with eighteen cans in three-can constellations. I mine them full with my mining cruiser and then haul the ore three cans a time in my Badger II. Even with three miner IIs in the cruiser, eighteen cans is more mining than I ever care to do in any one play session.
True, the cans are spendy if you buy 'em retail. But you can scoop 'em for free with the Badger II if you pay attention, there are a *lot* of cans floating around with no anchors.
The toughest most time-consuming part of this plan is anchoring the cans; in good roid belts you'll find it tough to find spots where you're within laser range of the roids and 5k from everything else. But, if you pick your way and take your time, you can find spots.
I will admit, though, that now that I've done this I'm absolutely *brutal* about stealing ore from the jet can miners who strip mine in "my" system. They are like locusts, and once they've been through, my can-stellation isn't worth much. So I haul their ore instead, and sometimes I cost them enough that they go jet-can elsewhere.

Absolute pants.
Speaking as an Ore Thief myself, our corp(Forced Asset Relocation Team) exploit the fact that the only people who can return fire against an ore thief is the owner of the can that has been robbed and any GANG mates the victim may have. Corp members are helpless unless in a gang with victim. Any non gang members who open fire against a thief will be taken down by concord.
And who says crime doesn't pay?

Yeah Ore Thiefs Should be able 2 steal , but the Ore in the can has been JETTISONED therefore the Ore does not belong to one person its up for grabs, if you were to leave your money from ur wallet in the street it would be your hard luck that any passer-by could take it with out you having any redress in the law, in short it would be your own stupid fault that u had put there in the first place.
