I'm at an asteroid belt when someone requests a chat with me. They said they had a lot of stuff they didnt want sitting in a cargo pod and said i could take whatever i wanted. When I tried taking something it said i was stealing and would be attackable. Since the person offering this was only 2000m from me and in a bigger ship i decided not to take anything.
Was i being setup to be attacked? Is there any way to make it so that a cargo pod can be lootable by other people with no penalty? If i had been attacked, could i have filed a petition against this person?

The person in question was about to kill you. If you want to petiton him you are more childish them him.

safe way to give something to some one in space:
A: drops a can with 1 ammo (or anything) B: drops what he wants to give into A's can A: takes his "gift" from his can

No. This sort of social engineering is all part and parcel of EvE. If they had used a bug in the game to kill you, then it would be petitionable. But clever use of game mechanics is (generally) not.
People do sometimes announce that they don't want the contents of their cans - if they have been killing NPC rats and can't be bothered to clean the cans, for example. I wouldn't take anyone up on the offer unless I knew them to be trustworthy, though.
Similarly, don't randomly accept offers to join a gang with people unless you're sure they're not ebil pirates.

If someone wants to give you an item, tell them to go to a station and you'll meet them there. You can then trade from inside the station safely.
If they refuse and say to take it from their can, tell them thanks, but no thanks.

This reminds me of a time I was exiting a station in high sec and passed a container labelled "FREE MISSILES".
By the time my warp to the gate finished, there was already some noob in local complaining he'd been unfairly blowed up.

sumtimes when i'm in a bad mood i use an alt and play this trick on noobs, spitefull but cheers me up no end.

next time this happens.....
move to the can, set your speed to 5 ms and align yourself to something anything will do, but a planet or a moon is good, then open the can and press ctrl and A and drag the loot into your cargo then immidiately hammer the warp arrow
what you get will probably be worthless but it will annoy the griefer and so is worthwhile
you need to keep jumping about for the next 15 mins or so altho i doubt the average grifer has the ability to locate you
dont forget to thank him for his kind gifts

If they have anything to give you, they can trade with you in the nearest station. No need to do it in space.
Make that suggestion next time. If they are out to just try to trick you, they will refuse.

So i only remain attackable to that person/corp for 15 minutes? if i can make it to a station and dock before the 15 minutes i assume i am safe as well, no? i.e. the station isnt going to fire on me (Unless its owned by that corp).

If you join a gang of who ever it is that wants to give you loot you will be able to take loot from his can without the agresion timers kicking in. You will staty saftly protected by concord you can take the loot from this kind person and your not hassleing him with going to a station.
I am a older pilot. often i have item that are usless to me wich i will offer to noblets i see in empire. ofc i am the exception. most are trying to kill you.

Another way other than the gang option to avoid being criminally flagged is to get the person to set u to +10 personal standing. If they do, when u take from the can you wont be criminaly flaged, and wont get the warning that u are about to commist a crime. If they wont do this, u just have to ask yourself why?

Another point I noticed: ganged and in area, fine. If he warps off while you are still there, cleaning up cans, WARP OUT ( or align and prepare). Even in gang, if the can owner isn't in that belt/area, you can be flagged to them. I found this out when I started offering free ore to newbies in system, provided they were in frigates. I ganged them so they could take from my can. I finally had to go get my hauler, and they were criminally flagged to me when I got back. --------- "Woof! What happens in real life doesnt translate very well to in-game. Of course I don't know much about icelandic law

If the hostile has you targeted with a passive targeter this will result in you dying. Same if you don't accelerate quickly.
Drop a can of your own, and ask the guy to drag from his can to yours. Only safe way.
