"Exploiting thwarted
There have been concerns from some users that we have let exploiters go too easily. Stand assured that we handle all exploits very seriously. Exploits vary in size and extent and on global impact on the game. Some exploits are such that many people actually do them inadvertently, while others systematically maximize their profit from them. On a case-by-case basis, we decide what to do with the exploiters, but the usual punishment is permanent ban from the game.
We have recently uncovered some networks of exploiters, many of them linked to online auctioning of credits and items. We have taken tough action against those and all those that were directly involved with them. All their accounts have been closed and all personal ( in game ) as well as corporate properties confiscated.
Soon we will publish a more explicit banning policy, so that users are well aware of the repercussions of their actions."

i will say one... that every big corp use (they pod me 100 times for that)
there is a way to make large standar cargo (not sec.) to stay in space for ever... dont know how :)

I only know of a group of people who have been banned for duplication of items which in turn they'd sell cheap and ebay earnings.
I never quite figured out how 'Gladiatrix' could have 2 Bil in his wallet and over 6 Bil in assets..
Anyways, Gladiatrix lived off of Ebay, so in turn, leeched out of EVE.
He seemed like a good guy, but this isn't exactly respectable.
Anyways, Gladiatrix and majority, if not all, of Fallen Angels has been banned.
CCP don't play when it comes to cheating.
Heh.. a friend of mine heard about what happened to Glad, and thought 'Mmm? Duplication?'.. so he went and screwed around and ended up making a second bestower.
Then about 5 minutes later TomB ganked his ass into the farthest reaches of Jove space. There lay TomB, in his Leviathon. DUN DUN DUN.. anyways, interrogation came through.. but was only warned for that he was only 'testing' the exploit.
There are rumors, and I wont point fingers or elbows at my various sources, but that Gladiatrix had a whopping 882Billion megacyte. The rumor states that Glad duped mega and sold it in high sec (which has been seen) for 6k in large amounts..
Go ahead - Exploit, then feel the wrath of TomB!

Been there, done that, got accused for something I havent done (apparently I was "dangerously close to being banned for reporting gm conversations") and I'm still annoyed about it.
I've even asked to see what evidence that they have that was in any way breaking the rules but they told me I couldnt see it.

i also hope they understand that they have commited a fraudulent act, i.e "fraud" and will be procecuted. it IS against the law to counterfeit money and sell for REAL money, even though its "game money" i hope others that do this in EVE understand how grave this actually is.

Actually no, you are wrong. It is NOT against the law to "counterfeit" 'fake' money and sell it for real money (IE. It wouldnt be illegal for me to photo-copy monopoly money and sell it for real money, however there may be copyright infringement in that instance). Unless you know the law, dont post useless drivel.

Exploiters stink. There is nothing worse than an exploiter. Ban is the only thing against them. I would like to see some bans based on things sold on eBay (it's against the eula right ?)
I really hope CCP has the right track to get these bastards down. A blacklist would be nice too (I don't know if it is against the eula tho - but knowing the chars banned for exploiting would give everyone out there a taste of what may happen if they try to exploit the game). _______________________________________________

Yeah, fraud. Unfortunetly, your grasp of the law is only on its basics. What you posted was drivel and I rebutted your main point on the counterfeiting.
They arent commiting fraud (in a legal sense) when they exploit game parameters in a video game, you may consider it to be fraud, but legally, they cannot be prosecuted for what they have done, CCP could file charges, but they wouldnt have a leg to stand on.

In most cases the items sold have the disclaimer that what they are paying for is the "Time" it took for the seller to aquire the object, and that all intangable game items remain the property of CCP.

On the whole prosecution thing..
It is fairly safe to say there is no definite answer to this question. Computer crimes are a very vague and very undefined area of the law.
I took a class in computer crime last year (I am a 3rd year law student in the U.S.) and at least under U.S. law it is very plausible that CCP could have at least a civil case to prosecute. There may also be criminal liability under RICO or wire fraud.
I've never heard of a fact pattern like this, but it would be VERY interesting if there actually were a prosecution brought against any of the participants.

I know law, thats why I am talking about it. I am also very familliar with how it works and how its worded.
What you are saying is completely without merit, how are exploiters 'stealing the service'? Now when you make your explanation, apply it to a piece of statute law, quote the statute and provide me the source (it better be a government source, or a reprint {IE. Cornell's reprint of the US Code}).

RICO only applies to organized crime, money laundering, that kind of thing, it cannot apply under these circumstances.
Now as for the vagueness of computer crime, all you need to do is show how computer crime is no different than the tangible equivilent and you will have yourself a case. I agree that CCP could have a civil trial, but civil torts have different rules than criminal trials, and I believe if you look at what the exploiters have done, it would be absolutely foolish to pursue one as you have questionable grounds in the first place (what they did barely constitutes any crime, and thats stretching the imagination), and secondly, CCP would only be wasting time and money for something that has arguably done zero damage to anything (again, you could say they 'damaged' the market economy which is integral to the game, but thats a big stretch when you consider the market as a whole).

I took a course about RICO, trust me, I know what it applies to. It applies to any "organization" that exists for the purpose to commit a fraud.
Organization has a very loose definition - it need not be any tangible partnership, corporation, or anything of the sort. It can simply be a network of individuals. How this applies to online crime is really an unexplored area of the law. There is a valid argument to both sides.
And you completely ignored my point about wire fraud. Any time you commit a fraud that utilizes ANY wired communication network (phone lines, fiber optic cables, etc.) in the U.S., you can be charged under the wire fraud statutes.
And yes, there is a very valid argument that if you are breaking the terms of service (read: EULA) of an online game and then benefiting from your actions via EBAY or other online auction site, you are committing a fraud chargeable under the statute.
TRUST me on this. And RICO could be established if there is a "network" of people in EVE or hell, an EVE "virtual" corporation that exists for the purpose of furthering the fraud. Yes, sounds like Fallen Angels might just meet the standard.
Just because a prosecution like this hasn't actually been undertaken in the past doesn't mean there aren't any valid arguments that it could take place in the future. It seems to me that if what I read in this thread is true, there is a very convincing argument that these crimes have taken place.
It would really just depend on whether the judge you get is computer literate or not, or capable of understanding these types of things.

I see where you are going with your argument, and I do believe you when you say you have taken a course on RICO. I trust that your understanding of the laws of the United States are far greater than I as am not a United States citizen.
I'm sorry for not addressing your wire fraud point, I read RICO, and just skipped over the wire fraud by accident. I guess for my response to that, and RICO, would be this:
You would have a much better case for wire fraud (a crime I didnt consider when I was posting) because as you did say, Wire Fraud does involve any fraudulent activities commited on wired technologies, however without looking for precedent setting cases, it would be up to the judge to decide if the exploit or products of the exploit constituted a crime and conversely it would be up to the defense to show that what has happened is not a crime, I would imagine they would cite cases from other MMOG's. RICO is a different story, you are very right about the in game corporations possibly constituting an 'organization' however, if you look at Title 18, Part I, Chapter 96 (RICO) and look at what must be true to be charged under it, you would need several stretches in interpretation of what has happend to justify it.
I mean all of the above with the utmost respect, I dont want to appear to belittle someone with as much knowledge as you. Strictly on what the law says, I dont see how this can apply without stretching out interpretations.
I would cite specifics, however this forum isnt exactly a law forum, and I've de-railed the subject a bit. In this conversation and or debate, I concede the victory to you because in the end, stretches or not, it comes down to interpretation and if the judge is technologicaly literate, he could go either way and set precedent for future cases (barring the 9th Circuit doesnt reverse the decision).
Good luck with Law, you already sound like you are going to be a good lawyer. Do you plan on doing criminal law?

Let's stop talking about the law and talk about the game. This previously mentioned group in individuals duplicated stuff, sold it to make isk, then flogged the isk on ebay for dollars. After the dolars were paid the isk were transferred.
What I want to know is just how much other stuff in game has been duplicated? How many individuals and corporations, haven't exploited to the same extent that it hasn't been so obvious? Can these people be traced, and the duplicate stuff removed?
It kinda irritating to find that you mining/barter/trade/run fd and pf for weeks to gather minerals to build a Battleship, only to know someone can produce fleets of them with little or no effort.
I would suggest some sort of ingame amenesty for those who come forward to the GMs now, and tell them what they have done, have the items removed, and permabanning of Ccard accounts from eve for those who don't. We all know something needs to be done, and fast, just wonder ca the devs spare the time and resources for a proper 'inquistition'.

What I want to know is just how much other stuff in game has been duplicated? How many individuals and corporations, haven't exploited to the same extent that it hasn't been so obvious? Can these people be traced, and the duplicate stuff removed?
It kinda irritating to find that you mining/barter/trade/run fd and pf for weeks to gather minerals to build a Battleship, only to know someone can produce fleets of them with little or no effort.
I would suggest some sort of ingame amenesty for those who come forward to the GMs now, and tell them what they have done, have the items removed, and permabanning of Ccard accounts from eve for those who don't. We all know something needs to be done, and fast, just wonder ca the devs spare the time and resources for a proper 'inquistition'.
If items can still be duped, TomB should focus on making the items code more robust.

I would never exploit, but there will always be petty little cheats in EVE, its a online game, EVERY online game has had its share of exploits/hacks. I just hope EVE doesn't turn out like other games which have been destroyed by hacks, and EVE is still young, exploits from new patches could come..

Yep. The game is buggy. I even found a dupe bug by accident. If I can ever figure out exactly how I did it I'll report it.
