just trying to get the nuances here...
Yellow means they are flagged for doing something bad (stealing from a container?) and with a skull means there is a bounty?
And you still don't want to attack either in high sec because you will get concord nuked , correct?
only ones you can attack without (concord) consequence would be red?

Not exactly, yellow means they have a sec status between -0.00000000001 and -4.99999999999. Flashing red means they have a sec status between -5 and -10. The skull and crossbones means someone has placed a bounty on them.
You can attack a flashing red player anytime/anywhere without worry. You cannot attack a yellow player in high sec without concord attacking you.

Flashing red could also mean they are flagged for aggression and you can attack them.

Does the concord response go away completely once you hit 0.4 space or it drops off a bit at a time until you hit 0.0?

If you attack someone who is not -5 or lower:
1.0-.5 Concord will attack you as well as the gate guns 0.0 empire to .4 gate guns will atack you 0.0 true no gate guns no worries 
(empire 0.0 are systems in empire that are 0.0 you can tell the difference as true 0.0 systems have leter/numerical names: ie D4KU-5 instead of true names: Hophib)

hmm isn't being flagged for aggression shown by a red blinking rectangle around them? Thoughed the sec status -5 was a blinking red background (well standard settings of course)

how long does concord agression last? in both high and low sec areas. what happens if you warp? does concord follow you?

aggression timer is 15 minutes. And escaping gancord is an bannable offence, so if you ever got attacked by concord just sit back and watch your ship go BOOM!

yep if you escape concord after aggression on an other player in higher security systems, you can be banned. But well escaping concord is nearly impossible.
And as for pirating, if you read most pirating happens in system 0.4 security or lower. Why? Because there isn't any concord. Then you have those suicide ganksquads in higher security systems. As long as the worth of your cargo is lower then their costs of the basic setup (mostly groups or single raven/caracal/kestrel) you don't realy have to fear them. Called suicide gankers for some reason ;)

About Concord being next to impossible to evade: Suppose you are in a Condor in an asteroid field in Empire space with no sentry guns or concord ships around. Couldn't you unload a single volley of missiles at a miner then warp out to a bookmark in the middle of empty space before Concord arrived?
... isn't Concord slower to respond at some secuity levels?
... would this be an exploit or a failed suicide mission?

I recommend forgetting about escaping Concord. The Concord commanders get close too 1k dps each. Plus insta lock, uber tracking, 4 scramble points per ship, etc. ~

As stated by the other poster, you can shoot people in 0.5 and higher sector but you will lose your ship for it period. If it does not happen, it is considered an exploit and against the eula.

Concord is not tankable.
Sentry guns you can tank or outrange (about 150km).
It's what people do when they gate camp in low sec.
Bear in mind that you can only gate camp in low sec or 0.0, otherwise Concord will spawn.
Look up the Crime and Punishment forum for more details about camping and tanking sentries.

you forgot the probeless safespot finding, the 4000000 pt ECM, and the 40000000000 points of sensors on their ships.
and infinite cap. of course they dont have to hold their cap for that long...
