Friend just lost his ship to a clever pirate and wanted to know if it was an exploit becuase he didn't lose his ship.

Hisec kills usually involve warring gangs, and the joining thereof. Ore theft is another method.
The "warring gang" trick works like this: the individual pirate or pirate corporation sets up an alt corporation, which they then wardec or have wardec them. The pirates then use the alts from that corporation invite unsuspecting travellers to join warring gangs. Once you're in, you're fair game for the scurvy rogues (who are frequently already hanging out a few clicks from you when you get the invite; I discovered this tactic myself by having it used on me).
This is not an exploit; it's a dirty trick, similar to a con job, much like tricking you into buying a shuttle named "Navy Raven" for several hundred million ISK.
Another tactic is playing ore thief. A common ore thief will warp in on hisec miners, steal ore from cans, and then warp out again. It's legal to shoot at an ore thief, but it's also legal for the ore thief to shoot back. This gives rise to ...
... the pirate ore thief, who will turn up at your mining operation with a combat-fitted ship and either pretend to or actually steal your ore. As soon as they open your can, they're a fair target-- but if you open fire, the pirate will cheerfully return it, and attempt to destroy your ship and walk away with the goodies.
This also is not an exploit.
Upshot: hisec is safer. It is not safe. No place in the cluster is truly safe, and I know of at least one Cerberus-flying pirate who hunts in Jita, of all places. Paranoia is your friend, as is keeping a level head; pirates in general, and highsec pirates in particular, make their living off your naiivete. If something looks peculiar or suspicious, it's probably a trap. Don't bite. Don't even nibble. You'll stay as safe that way as it's possible to be.

I don't know a link, but here's what I do know:
You can't shoot anyone in high sec apart from: war targets, corp members, and anyone with an agression timer to your corp and people you have kill rights to (and outlaws).
Your friend probably got a timer to the pirate and/or his corp by taking something from his can. Then he has an agression timer to that player/corp, and can be shot without concord interfering.
If someone ticks any of the boxes above, they will be red in the overview (on default settings) or green for corp members.

if you criminally flag yourself in hi sec and dont lose your ship then its an exploit

IIRC its not if you get flagged
its if you AVOID/escape CONCORD its a exploit =)
