Heck, gang membership NEVER allows you to shoot somebody for free, but could allow the war enemy of a gang member to shoot at you for free. No NPC corp members can freely shoot at each other, but all members of the same player-owned corp can. This protection does not extend to alliance mates. I believe you can duel by each jettisoning a single unit of ammunition and having your opponent "steal" it.
