Also, a quick search of the portion mentioned in the original post shows that companies just copy sections of each other's ToS / EULA word for word. And in CCP's case, apparently they do so even when it doesn't make sense.
A good case for that section of the EULA to be updated with EVE specific information.

But yeah, good catch. Whenever they change the EULA they should explicitly state what they changed. Having to read the whole thing again just to figure that out is a gigantic pain in the ass.
Providing Change Logs as summary information for revised contractual documents like EULAs?
Shirley you jest.

I believe that is Lawyer-speak for "Don't glitch any CCP Polaris items into your hangar, we won't like it."
"CCP Dolan is full of shit." - CCP Bettik

Or if you engage in a scam involving impersonating another character. I'm sure no-one ever tried that with no intention of cheating at EVE.
Or if you did something entirely outside the game on TeamSpeak, say. How does one cheat at EVE on TeamSpeak?
Or if you have some things "that are inappropriate for the level or rank of the character contained in the Account", like - for example - a level or rank. I have never had a level or rank in EVE. How do I get one? Is this text copied wholesale from some sort of generic MMO paperwork (hint, yes, as Google will tell you)? |

Totally agree. Someday when I have money to burn, I'm going to mount a legal challenge to all EULAs (a) longer than two pages, and (b) which are unable to be understood by a high school senior with an average grade point. There is no way these ridiculous pieces of work are binding in their current literally unreadable form. The entire notion of needing a trained lawyer to understand an agreement to simply play a game defies the intent of a functioning legal system - and thus it is most likely unconstitutional (or insert your country's core bill of rights here) and non-binding. We probably just need to mount the challenge.
Yeah, I know, the choir is bored ...
Seriously, CCP lawyers, for once do something with the slightest though toward your target audience: post an update to the EULA with **CHANGE BARS**!
Oh, and why does it say on the last line "Updated April 16, 2012" if we are having to sign it over 3 years later? |
