Are they ok to use as long as only NPC rats get hit by them? ( i mean in Empire space )

That being said though, in certain situations, they're extremely useful. Foremost among these would be when swarmed by drones, one volley of smartbombs in your highslots could in theory destroy them all, and if your enemy used them as his only form of damage, well, you're peachy then aren't you ? Other than that however, and maybe getting rid of interceptors, don't use them...

yes, they're very situational but quite effective when used properly. On the other hand, using them in empire is just an accident waiting to happen. Don't use them in Empire I'd say.

Bah, don't listen to 'em :P Smartbombs are insanely useful in lvl 1 missions, as a well timed medium smartbomb can instantly complete some of them for you.
CONCORD won't pop you for hitting anything spawned in a mission (I've let a few bombs off near warp gates, jump gates, asteroids and beacons, and nothing happened), just make sure you don't hit other players. Outside of missions though, I'd recommend avoiding the use of smartbombs.

Before if you smartbombed and someones can was nearby you were grand. Now it seems if there is a wreak nearby that concord will beat you up

They have their place. But just remember: smart bombs aren't.
If you're doing DS missions, they can be useful, unless you like drones. But if you have a mission at a gate, don't even bother, unless you hate your ship and want its insurance money.

However, with the changes to the scanning system using them in empire missions (especially on an expensive setup) will be a VERY bad idea now.
Here's roughly how it would go down:
1.) You get scanned outside the station in your CNR, you have a large smarty equipped 2.) Recon probes you down (will be even worse soon with recon probe launchers) 3.) They find you and move to between 3 and 5km of you, you activate the smartie, they loot your can.
They certainly do have their uses though, Doing Enemies abound 1/5 in a raven is much easier if you pop all the tackling frigs with smarties then refit for the rest of the mission.
