Yea, you can shoot POS when at war. However, unless it is completley defensless POS, why would even attempt to shoot it in Empire? Seriously, even lightly defended Empire POS is impossible to take down, since there is no way to get a capital ships to it.
Also, it is possible to refuel the POS with NPC alts, so long as they have access paaword to the forcefield, they can come in, jetisson the fuel and go, while defenders replenish the suply from the jetcan.
Anyway, I kinda think it is a dumb and stupid thing they did with Concord. POS are more than capable of defending themselves in Empire w/o idiotic COONCORD showing up to break up the fight.

Requiring a wardec to shoot a POS in empire ensures consistency. Personally, I hated the fact that any n00b corp could even try to shoot a POS without a wardec.
Although, I imagine that it would extremely hard to destroy an empire-based deathstar without dreadnaughts, although there's little point for a deathstar in empire.

Strange, people used to take down all kinds of POS before dreads were even in game. It took balls of steel and a huge fleet, but it could be done.
A small or med POS can be taken down with very little trouble by a BS fleet as long as it isn't filled to the hilt with large guns (and they rarely are since they use a lot of resources to keep online and it is, afterall only empire)

You are correct about "balls of steel" and a "fleet" part. Now, a Medium POS Caldari Tower can comfortably sustain: 20x Cruise Missile Launchers (70,000 Missiles Per Launcher + POS Bonus to Flight Time/Speed/Sig Radius) 15x Sensor Dampeners (300km range/50% Damp) 5x Warp Scrambler Arrays (150km range) 5x Webbification Arrays (150km range)
Now, what would you need to take down a POS like this in Empire? Something pretty big an ugly. Of course, it is possible, but the losess to the attacker will be pretty much bloody ones.
I have run a test on SiSi with some friends. POS like this took down 65 battleships, 25 cruisers, and 30 frigates, without breaking a sweat. Now, add to it the idea that it can be refuled by an NPC alt, whom you can not shoot because CONCORD will get involved, and you got yourself pretty much an impregnable deffence.
Again, you can be correct that with the really large number of people, and if you are not worried about your losess, it is possible to take down an Empire POS in a wartime.
I dont even want to think what will be needed to neutralise a "Deathstar" type of a POS in Empire. Most Empire POS I have seen are extremley well defended. With Maxed out Deffence grid, usually offline, wating for the time when the corp. is war declared. Because, then, you take offline all the production stuff, online the "killer deffence" and watch the fodder fly.

The only reasons I could see for wanting a POS in Empire would be if a system has no stations, T2 manufacturing, or moon mining.

And what would be the point of having a Deathstar in Empire? - I have seen them, T2 producers, quite a few of them, have the "Deathstar" POSs in Empire.
Other than T2? Who the hell knows, people are crazy, they want to have their "own home" and POS is the answer, till CCP implements the "player housing" thing they have on the Drawing Board.
