Whilst it is just about acceptable to not have the Broker Fees returned on a failed Contract it is unquestionably wrong for the Contract Deposit not to be repaid.
Is the mechanism broken or just part of another CCP language anomaly?

it's normally like that. you will get the deposit back if your item gets sold. the deposit is there to keep you from puting up auctions noone wants to buy.

No that is wrong. Despite this being the norm a 'deposit' should always be refunded for a failed transaction.
The fee is what stops spam. If this is not the case then the Contract system is doomed to failure.

no, not really. if the deposit was returned on failure, than the deposit would always be returned and that would be useless. the broker fee is not to stop spam as it's too small anyway. if you're posting normally good auctons, than the deposit would do nothing harmful to you. than again, ccp should let bids be region wide to help good auctions in bad areas.

Yes a 'non-returnable' deposit clearly states it is that. The Contract desposit does not.
Fine continue to be happy with a flawed feature meanwhile prices will either rise to compensate or sellers will just use the Market and the Contract system will gather dust through its sparse use.

it's pretty normal for deposits not to be returned for failed auctions. not exactly quite sure how eve's work though.

Yes but this normality is incorrect. This is my point.
And back to 'non-refundable' deposits for a moment, these generally are the kind paid by buyers to secure a deal not by sellers. Sellers pay fees, and there already is a Contract Fee.
12+ million ISK is also no small sum to waste on for example a reasonable priced Freighter auction that fails.

in real life someone was to file paper work and pay for adversing and such and thoes people deserve to be paid for thier work.

I wouldn't go as far as saying "deserve". Legal entitlement, certainly, but people who use words like "imagineer" in their everyday speech don't deserve to live, let alone get paid in my opinion.

Yes and that's what the fee is for and/or any commission (as seen in Market transactions) but only once, in the latter's case, a deal has been succesful.

It is simple to get around the fees for expensive items: set an item exchange contract instead of an auction, and ask for the same item in return. You only pay the minimum contract fee ( 10k isk ) and the item is listed. If someone is actually interested, they can eve mail you an offer.
I agree, deposit should be returned. It is there to cover the tax, not the listing fee.

Let's say you made an auction and nobody is bidding. Bidding with an alt may by a way to get back your deposit ?
