Edited by: Majin Apis on 16/02/2007 14:03:48 CCP Arkanon posted in the Information area that he would not give out details regarding you as a player if you asked him. How does this effect you regarding the Data Protection Act? I thought if you asked that a company had to give you any information they had concerning you?
I'm curious if I misunderstood or if the law regarding your characted inside an MMO is a little screwy(aint it all?)
Not flaming CCP who are a great company.

I believe CCP is based in Iceland. Isn't the Data Protection Act a US law?

Most European countries have similar laws, but it only concerns them giving the information they have about you to you if you ask for it, not to someone else. The question Arakanon answered was whether or not he would give out information about you to everyone if you ask for it. =AFK=

I think he meant that CCP wouldn't give anyone else info about you, even if you would allow CCP to do so they wouldn't - of course all within the boundaries of law.

Edited by: merc999 on 16/02/2007 14:30:09 the servers are based in London, and as such all data on them fall under the DTP.
You can request a copy of that data by writing to the Data protection officer of the company that runs the servers, there will probably be a fee to be paid, but it isnt much, I think a maximum of ten pounds..(but could be wrong on that) *Snip* Please dont be horrible to Bob with your Sig - email [email protected] - hutch |

Hes refering to the data protection act 1983, basically states that a company which keeps records of you within teh UK cannot keepdata forlonger than neccesary and that it must be secure, and can be requestedto be destroyed at the person wish (except law enforcement etc).
However it does not state that they must give you what ever info they have on you.
That however is the Freedom Of Information Act 2000, even though the company is in iceland if they keep information of you within uk borders ie on eve servers in London it has to be released to you on request and proof of indentity.
The act Can be viewed HERE it is also a place to lodge a complaint agaisnt any company/UK authority not adhering to this LAW.
I sudgest you do this if you are getting no joy with CCP.

The Data Protection Act 1998 gives you the right to access information held about you by organisations. The act governs how organisations can use the personal information that they hold - including how they acquire, store, share or dispose of it.

These laws are ofcourse about info about your person not about your charactar on the server. Also anything that they have to keep longer because of other laws doesnt fall under this law. For taxes most countries demand all financial stuff is kept for 5 years or even longer. This makes it so your financial info (your payments) are kept for longer.

Data protection only covered personal information, ie name credit card address etc... character names corp etc and the accounts themselves are actually considered property of ccp by law it states it in the eula. So in reality CCP could take away your account even if you'd pre paid for months and you could do nothing about it, it would be bad business sense but still possible. So it is at ccp's discretion to release info about peoples accounts as long as non of the info relates to the account holders real personage. Ie they can say this character has been cheating but they can't say this character has been cheating his real name is joe blogs and lives at 42 whereever street.

Actually no, if you are clear in your wording, they have to provide you with all and any information on your account. Character history, all logs, chats, any "notes" they've made on you. If they refuse, after you've put it in writing, you can complain to the Data Protection Comissioner and CCP can get heavily fined, and forced to give the information anyway.
Since CCP has a UK subsidiary which owns the London office, and since that office is where the servers are, which contains your character and player information, they would be obliged to assist you.
It costs a maximum of ú10 and they have 40 days to respond. Your signature exceeds the maximum allowed filesize of 24000 bytes - Devil ([email protected]) |

LOL, no, and they have nothing like it - this is an ongoing issue between the EU and USA because USA insist on passenger name records being given to the US before a flight can leave Europe, but they refuse to undertake to protect the information so giving it to them is illegal under european law.

He posted that he wouldn't divulge the data in a public post. Totally different thing.
I suppose he (or CCP) would divulge privately, to you, the data they have about you, unless they have reasons to dubt you are effectively the person you depicted to be.
In all honesty I wouldn't be happy if CCP divulged, even to me, the data on the credit card I use for billings, unless they are totally sure I am allowed to see them.
For example, a 16 years player chan ask for the credit card data of his father card, used to pay for EVE by the father, and then use those data to buy things on internet.
