I saw a guy in empire last night being a dork and noticed he had a -3 sec rating and a 5 mill bounty on his head. He showed up as yellow with a little picture of a skull in the overview.
Can I shoot him in empire?

CONCORD will only allow you to shoot at people with -5 or lower sec rating in secure space.

You can shoot him, although if you are a fan of your ship it is not suggested. Any openly aggresive actions (shooting someone) taken in empire space will be responded to with CONCORD interaction. The only exception to this is if you are at war with another corporation, then CONCORD stays out of the way.

Wrong. There are other exceptions: - as said above.. you can shoot people with -5 sec status and below without concord intervention. -If someone aggro'd by stealing ore or looting one of your wrecks, etc -If someone shot at you first, you can shoot back without concord stopping you

Actually you don't get to shoot at anyone if they steal your wrecks your loot yes but not if they only take the wreck(s).

But it won't be just 1v1. It will be 1v1+Concord so it would be suicidal for them to try shooting at you. Not that it stops some people having a go.

If someone in say, 0.6 Sec Sector comes in and flips my can, by taking my ore from my non-anchored can (jettisoned can), That gives me full rights to shoot at them as they were flashing red on my overview after doing it. or Will Concord come in and shoot me?

You should be allowed to shoot at him. But once you fire he can fire back.

Another way to safely open fire on someone in high-sec... If you have Kill Rights on him.

Think of it this way (using your 0.6 example). The magic powers of the EVE universe let CONCORD know when some jackass flipped your can and fired off the aggro timer. Think of it as lowjack for your jetcans, except CONCORD steps aside and says, "Ante up -- he wants to pick a fight," leaving you to finish the job. Petty theft, I guess, is OK in New Eden -- CONCORD has other things to worry about like watching that gate that just seems tooooo suspicious.
Kill the jackass who flipped your can, or fight him, die, and learn from your mistake.
Either way, in THAT case you described, CONCORD is gonna let you get it out of your respective systems without chaperoning the party.
