I just got scammed for 5 Billion ISK on a character transfer.
I did everything by the book according to GM's advice.
I made sure it was posted on the forums and we exchanged evemails.
This did Not stop person from taking my 5 Bil and bailing.
I will be reimbursed the ISK... In a few weeks.
His account will be baned but Im sure he wil find a untraceable way to send it to his main.
Who is the real loser here?
I am seriously thinking of declaring a RL lawsuit on the individual that scammed me.
I barely have a leg to stand on legal wise but I could always force the person into court for causing me emotional distress
Also I can say he scammed me out of property
The EULA states that ALL INGAME property is CCP's BUT does the EULA stand in court?
further more I could go to court and seek CCP's consent to let me sue the person.
I wont have a chance in hell of winning, But I will put the person through months and months of hell
I have no life and no job, If I force this person into court I will waste as much time as possible.
he will be forced to skip is job and take days each week to come to court.
Also I will be able to get a hold of his real life information, by declairing a lawsuit CCP would be legaly forced to hand it over to authorities.
I would then pay out of my own pocket for background checks and any dirt I can find on person.
I will make 100 different accusations if need be.

Its a game and you own nothing, you just reorganised a bunch of numbers on a server somewhere in London. At no point should you have ever thought of it as anything else.

hey, you are getting the money back, why so mad?
alot of people get scammed with no recourse. CCP can trace the isk if its moved from the char that took it. Just chill.

First, you cant sue because you dont have a case. You see, real life laws does not cover what happends inside a online game. So if you got scammed ingame credits for a ingame character. Yes its illegal by CCP terms. he will be banned. you will get your cash back. But the real life law does not - and should not - cover game incidents.
Also, EULAS are also built by not one or two lawyers - or by a game company, but by the game companies as a whole. Not just CCP, but all game companies. If you compare the terms, you will see a lot being said in them all. Ofcource CCP stands free to make their own EULA, and I am sure they did. But they have the experience from other EULAs to draw experience from, in addition to the laws of the country they operate in.
I can feel your pain, but as said, you dont have a case. Let CCP handle it. Not that you have much choise doing anything else

I'm sorry someone cheated you out of the isk.
Sadly it's not the best idea to ask the internet for legal advice, if you think you have a case against the guy you really should talk to a lawyer and explain the entire situation, only then will he/she be able to give you decent advice. Anything anyone here can offer is really quite useless.

To be honest, this post is an embarassment to your alliance and the playerbase of this game.

The ISK you were scammed of is digital, and belongs to CCP hf, not you.
As well as that, the EULA is a legal document that covers CCP's back. CCP hf. have control over all the assets in game at any time, so you've taken no physical loss other than being angry about losing a video game.
Oh, and just for final clarification, that clause "Game Experience May Change During Play" is a warning that you may become angry with the situation in game.
In fact, given this post has been quoted and you can't edit it, the person who scammed you could probably counter sue and with a good lawyer win a case aganist you for harassment, and for making false accusations a claim of attempting to pervert the course of justice.

Given the medium, thats highly debatable....
The op's could only have an issue with ccp, if it held any meaning what so ever...
failer to uphold rules/policies agreed to by all parties... which isn't the case here..... and certainly given the nauture of this example... ccp could just pull out the golden ticket anyway.... as it's totaly game related.
Thats the only time ccp become compable, it's just you'll in most instances have a hard time proving it.... i could give you my shinning example of that, as i went through a case with my solicitor a couple of years back... but i dont think it would much appreciated here and now.....maybe one day
