My corp mate is telling me that dropping a can in a market hub or other popular system filled with Veldspar and naming the can "Free Ore" and shooting anyone who takes from it is against the TOS. Is this true? ________________________________________________

I hunt baiters who put "free stuff" cans out. I have a lot of experience with these rules as a baiter-hunter so trust me i know. ____________

saw some pretty good ones lol around that theme
some guy put a can above a gate and waits for a caldari navy raven or other faction monster to go through in highsec
using a kestrel, he locks the guy (and the can) and shoot a volley in the can
very often the guy fires back and concord comes.

Lol... and personally, while I see why they'd have it illegal in newbie systems, I still think it shouldn't be. There is a big ol' warning sign that pops up the first time you open some one else's can. If they ignore it, then they take the risk of getting blown up by my Iteron mk 1.  ________________________________________________

Correct me if i'm wrong, but I believe fullmetalpwn knows what people think about can baiting. It's immoral to bait and kill newbs, but that's not what he's asking.
Having just read the TOS from start to end, can baiting is not explicetly banned. However the following statement may indirectly apply:
#15 You may not do anything that interferes with the ability of other EVE Online subscribers to enjoy the game or web site in accordance with its rules. This includes, but is not limited to, making inappropriate use of any public channels within the game and/or intentionally creating excessive latency (lag) by dumping cargo containers, corpses or other items in the game world.
However, I don't think this rule is intended to cover this situation. There are aditional rules regarding griefing covered in the player conduct section of the player guide, but they are described more as guidelines rather than black and white rules.
There doesn't seem to be any written prohibition of can baiting at newb stations, but there's certainly better ways to make money and/or have fun in Eve. Hope that information is accurate and helpfull.
